If you have had DePuy hip replacement revision surgery for an ASR hip implant since March 2015, you could qualify to participate in a new settlement for recipients of failed DePuy hip implants.
Johnson & Johnson’s DePuy ASR metal-on-metal hip implant has resulted in thousands of lawsuits since a huge recall was announced in August 2010.
The recall came after the United Kingdom joint registry announced that 13 percent of DePuy ASR hip implants fail to the extent that the patient needs DePuy hip replacement revision surgery.
The chromium and cobalt components can wear down over time, causing tiny metal pieces to shed. These metal fragments can burrow into tissue, causing a host of problems. Pain, swelling fluid retention, bone death and tissue death are all possible.
If your DePuy ASR hip replacement failed and you have undergone revision surgery since March 2015 due to one or more of the following issues, you could qualify for this new settlement:
- Failure of the metal on metal hip implant requiring early replacement
- Dislocated Hip
- Immobility
- Leaking of toxic substances in your bloodstream from your hip implant like chromium or cobalt
- Cancer
- Degenerative Heart Disease or Cardiomyopathy
- Loss of bone strength or structure which can result in bone fractures
- Tissue death for any tissue surrounding the implant
- Non-cancerous tumors or pseudotumors around the hip implant
- Cobalt poisoning
- Metallosis or metal poisoning due to chromium or cobalt particles from the hip implant leaking into nearby tissue or the patient’s bloodstream
Nearly 37,000 ASR hip implants were done in the United States.
DePuy Hip Replacement Revision Surgery Raises Other Risks
Studies show patients who undergo DePuy hip replacement revision surgery are nearly four times more likely to experience hip dislocation than those who have not undergone revision surgery. Other risks include infection, blood clots, differing leg length, fracture, nerve damage, and new bone malformation.
DePuy hip replacement revision surgery is a more complicated procedure that takes longer than an original hip replacement surgery. Bone and tissue can suffer damage from the original hip replacement procedure and from the metal poisoning that can occur from the metal-on-metal DePuy ASR hip system.
Surgeons often need to use specially designed hip revision parts that are intended to compensate for the lack of healthy bone and tissue.
The company faces allegations that it knew DePuy hip replacement revision surgery was going to be needed within a relatively short time after original placement, yet failed to warn patients about that possiblity. Patients accuse DePuy of fraud, failure to warn, gross negligence and malice, and willfully concealing the ASR’s intrinsic problems from the public.
If you have needed DePuy hip replacement revision surgery for an ASR implant since March 2015 because of dislocation, immobility, metallosis, infection, or any other debilitating adverse effect, you could qualify for a portion of the DePuy ASR settlement.
