A new class action lawsuit alleges Samsung unlawfully collects and discloses website visitors’ private data and communications.
Plaintiff Vedat Asrak filed the class action complaint against Samsung Electronics America Inc. in a California state court, alleging violations of state and federal privacy laws.
According to the lawsuit, Samsung violates California privacy laws by collecting, using and disclosing website visitors’ personal data and communications via tracking technology on its website, samsung.com.
The Samsung website features a pop-up consent banner that states it uses cookies to personalize user experience, analyze site traffic and keep track of shopping items, the lawsuit states.
However, the lawsuit alleges that even when users opt to disable tracking cookies, Samsung continues to collect and disclose their data.
Samsung website visitors’ privacy violated, lawsuit alleges
Asrak claims that Samsung’s practices infringe on users’ privacy, intentionally deceive consumers and allow third-party marketing companies to access private details about users’ interests and browsing history.
The lawsuit argues that Samsung’s actions violate several privacy laws, including the California Invasion of Privacy Act and the Electronic Communications Privacy Act.
Asrak seeks to represent anyone in the United States who visited Samsung’s website and rejected online tracking technologies through the consent banner.
The lawsuit accuses Samsung of invasion of privacy, intrusion upon seclusion, unjust enrichment and violations of California’s Unfair Competition Law and the Comprehensive Computer Data Access and Fraud Act.
The plaintiff is demanding a jury trial and is requesting damages, disgorgement of profits and an injunction to prevent Samsung from deploying tracking technologies on users’ computers without their consent.
Meanwhile, Samsung recently asked a federal judge in Illinois to dismiss a class action lawsuit alleging it illegally collects users’ biometric data through facial scans in its Gallery app.
