Paint manufacturer Rust-Oleum Corp. has reached a settlement agreement with a group of consumers over claims that it falsely advertised its “2X” spray paint line as providing twice the coverage of other general-purpose paints.
Notice of the settlement was filed with the Illinois federal court on Dec. 10.
The parties say they require additional time to process the documentation of their agreement and expect to be in a position for the plaintiffs to file the dismissal paperwork within 60 days. The parties also requested that all current deadlines and hearing dates be stayed.
The settlement resolves a proposed class action lawsuit filed in November 2024 that claimed Rust-Oleum sold products that did not perform as advertised. No class was certified, and the settlement does not establish relief for a class of consumers, according to the notice filed with the court.
The consumers, who sought to represent a nationwide class, argued that Rust-Oleum’s “2X” spray paint products — including Painter’s Touch 2X Ultra Cover, Acrylic Enamel 2X Coverage and American Accents 2X Ultra Cover — failed to provide the promised coverage, according to the complaint.
According to the lawsuit, the advertising was “particularly egregious” because Rust-Oleum’s own website and technical data sheets allegedly showed the products did not provide twice the coverage of comparable general-purpose paints, despite continued use of the “2X” labeling.
Rust-Oleum accused of breach of warranty, unjust enrichment
Rust-Oleum was accused of breach of express and implied warranties, unjust enrichment, and violations of consumer protection laws.
Rust-Oleum denied the allegations and moved to dismiss the class action complaint in June 2025, arguing that the plaintiffs failed to state a plausible claim for relief under federal law. The company also argued that certain plaintiffs lacked standing to pursue claims involving products they did not purchase and sought dismissal of nationwide class allegations, as well as claims related to unidentified additional purchases.
The parties engaged in settlement negotiations and ultimately agreed to resolve the case on an individual basis. The notice does not disclose any monetary terms or consumer relief, and the parties indicated they expect to file dismissal paperwork within 60 days.
In other recent settlement news, Google recently agreed to pay $630 million to resolve claims from all 50 U.S. states that it violated antitrust laws by monopolizing app distribution and in-app billing services through its Google Play Store.
