Monsanto Roundup glyphosate lawsuit overview: 

  • Who: Thomas Lane II filed a lawsuit against Monsanto Company. 
  • Why: Lane claims Monsanto knowingly sold Roundup weedkiller containing the allegedly cancer-causing chemical glyphosate and the surfactant POEA. 
  • Where: The lawsuit was filed in Minnesota federal court. 

Monsanto was negligent by marketing and selling Roundup weedkiller due to it containing the allegedly cancer-causing chemical glyphosate and the surfactant POEA as active ingredients, a new lawsuit alleges.

Plaintiff Thomas Lane claims the glyphosate and surfactant POEA found in Monsanto’s Roundup weedkiller makes it “defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce.” 

Further, Lane argues Monsanto failed to properly warn consumers about the dangers associated with being exposed to the chemicals in Roundup weedkiller. 

Lane says he used Roundup for “recreational gardening” and “lawncare” for a “significant” part of his life, arguing he followed “all safety precautions and warnings” while using the product. 

Despite the safety precautions, Lane claims he developed lymphoma as a result of being exposed to glyphosate and surfactant POEA in Roundup weedkiller, calling his cancer diagnosis “avoidable.” 

“Plaintiff’s injuries, like those striking thousands of similarly situated victims across the country, were avoidable,” the Roundup lawsuit states. 

Monsanto lawsuit alleges Roundup knew product was ‘dangerous,’ ‘defective’

Lane, meanwhile, claims Monsanto manufactured and sold Roundup weedkiller “with full knowledge of its dangerous and defective nature.” 

Despite this, Lane argues farmers “across the globe” have been using Roundup for nearly 40 years without being aware of its “carcinogenic properties.” 

“Defendant discovered the herbicidal properties of glyphosate during the 1970s and subsequently began to design, research, manufacture, sell and distribute glyphosate based ‘Roundup’ as a broad-spectrum herbicide,” the Roundup lawsuit states. 

Lane claims Monsanto is guilty of negligence, strict liability, failure to warn and breach of implied warranties. He demands a jury trial and requests compensatory and statutory damages.
