An Alabama woman is suing Monsanto Co., alleging its Roundup herbicide product is “defective, dangerous to human health, unfit and unsuitable” to be marketed and sold.
Plaintiff Helen Chandler claims her late husband’s exposure to Roundup caused or was a substantial contributing factor to him developing Non-Hodgkin’s Lymphoma and later dying from the disease.
Chandler argues Monsanto knew or should have known that glyphosate, the active ingredient in Roundup, is associated with an increased risk of developing multiple types of cancer, including Non-Hodgkin’s Lymphoma.
“Defendant has known of this association since the early to mid-1980s and numerous human and animal studies have evidenced the carcinogenicity of glyphosate and/or Roundup,” the Roundup herbicide lawsuit says.
“Plaintiff’s injuries, like those striking thousands of similarly situated victims across the country, were avoidable.”
Monsanto compared safety risks of Roundup to table salt, lawsuit says
Chandler alleges Monsanto ultimately “under-reported, underestimated and downplayed the serious dangers of Roundup,” while “negligently and deceptively” comparing the safety risks of the herbicide product to everyday foods, such as table salt.
“Defendant continued to issue broad and sweeping statements suggesting that Roundup was, and is, safer than ordinary household items such as table salt, despite a lack of scientific support for the accuracy and validity of these statements and, in fact, voluminous evidence to the contrary,” the Roundup herbicide lawsuit says.
Chandler claims Monsanto is guilty of negligence, breach of implied warranties, and strict products liability via a design defect and a failure to warn.
The plaintiff demands a jury trial and an award of compensatory and economic damages and punitive and/or exemplary damages to collectively compensate for pain, suffering, emotional distress and loss of enjoyment of life, among other things.
Monsanto agreed to pay $160 million earlier this year to resolve separate claims the company contaminated stormwater and drainage systems in the city of Seattle with polychlorinated biphenyls.
