A new nationwide class action lawsuit claims Roblox violates children’s privacy by secretly tracking their data without consent.

Plaintiffs Michael and Salena Garcia filed the Roblox class action lawsuit against Roblox Corp. on April 18 in California federal court, alleging violations of federal privacy laws.

The Garcias say they allowed their 12-year-old child to use Roblox, thinking the platform was safe for children. However, they claim the company was secretly recording their child’s online interactions and sharing that information with third parties without parental consent.

“Had they known the truth that Roblox would effectively spy on their child’s activities and identity for profit, they would not have allowed their child to use the platform,” the Roblox class action lawsuit says.

Roblox allegedly used audio fingerprinting to track children

The class action lawsuit claims Roblox’s code uses canvas fingerprinting to extract a unique device signature, including audio fingerprinting, to generate unique sound-based identifiers for tracking users across sessions and devices.

The platform also logs IP addresses, mouse movements, keystrokes and other telemetry data amounting to “an electronic wiretap on every user interaction,” the Roblox privacy class action says.

The Garcias want to represent a nationwide class of potentially millions of people, including children and adults, who used the Roblox platform at any time from July 1, 2021, to the present.

The lawsuit asserts claims for: 

  • Unlawful interception of electronic communications in violation of the Electronic Communications Privacy Act.
  • Unlawful access to and disclosure of stored electronic communications in violation of the Stored Communications Act.
  • Unlawful collection of children’s personal information in violation of the Children’s Online Privacy Protection Act.

The class action lawsuit seeks injunctive relief to bar Roblox from tracking and collecting users’ data and to delete all information collected from children without parental consent, as well as statutory and punitive damages, attorney fees and litigation costs.

In January, a class action investigation was launched into growing reports of gaming addiction and its impact on mental health, especially concerning Roblox.

    My daughter has been playing Roblox for quite a few years and was addicted to the point that I had to take away her devices. She also played with some friends who had the same issue. In addition to this, she was bullied and harrased by a few people online and when I reported it to Roblox, they blew me off and did nothing to protect my daughter and refused to respond to questions. I of course saved the emails. But now, learning about this, I am even more irate and this company needs to pay. Please contact me as I wish to be part of the case and see what can also be done about the lack of protection online from bullies by Roblox.

    I have an 11 and 12 year old who got addicted to Roblox, they would have a set amount of time on their devices for homework and free time and they would end up being on Roblox instead. I’ve had to take away their devices which is difficult because they need to get work done online. Please add us.
