A new class action lawsuit accuses Rent-A-Center of sending unsolicited text messages to phone numbers registered on the National Do Not Call Registry.

Plaintiff Dushawn Dante Minor filed the class action complaint against Rent-A-Center on Jan. 7 in California federal court, alleging violations of the Telephone Consumer Protection Act (TCPA).

According to the lawsuit, Rent-A-Center negligently, knowingly and/or willfully placed unsolicited text messages to Minor and others on their respective cell phones, which were registered with the National Do-Not-Call Registry.

Minor claims Rent-A-Center sent numerous unsolicited text messages to his phone for the purpose of soliciting business while the number was registered with the Do Not Call Registry.

Lawsuit: Rent-A-Center texted consumers without consent

The class action lawsuit alleges Rent-A-Center violated the TCPA by sending consumers’ mobile phones non-emergency advertising and marketing text messages without prior express written consent.

Minor claims the TCPA was enacted to protect consumers from unsolicited and unwanted telephone calls like those alleged in this case.

Minor is looking to represent anyone in the United States who registered on the National Do-Not-Call Registry for at least 31 days and received more than one telephone solicitation made by or on behalf of Rent-A-Center for the purpose of promoting its goods or services within any 12-month period within the four years prior to the filing of the complaint.

He is suing for violations of the TCPA and is seeking certification of the class action, damages of up to $1,500 per call, fees, costs and a jury trial.

Similarly, real estate brokerage Fathom Realty was sued for allegedly violating federal telemarketing laws by sending unsolicited text messages to consumers. The company later agreed to a $2.85 million settlement to resolve the class action claims.
