If you were a RealtySouth customer and were involved in a real estate closing at any time from September 23, 2003 to March 1, 2009, you may be able to claim up to $447 from a class action lawsuit settlement over unlawful fees.
According to the RealtySouth class action lawsuit, RealtySouth violated the Real Estate Settlement Procedures Act (RESPA) by charging individuals a $149 “ABC Fee” (sometimes called an “Administrative Brokerage Commission”) even though no such service was performed. RealtySouth denies all allegations of the lawsuit.
As part of the RealtySouth RESPA class action settlement, you can claim a refund of every $149 ABC Fee you paid to RealtySouth in connection with a federally related real estate closing between the dates of September 23, 2003 to March 1, 2009. The maximum refund you can claim under the RealtySouth settlement is $447.
In order to get a refund under the RealtySouth ABC Fee settlement, you must submit a valid claim form and supporting documentation to the Claims Administrator no later than December 15, 2010. This can be done via email to [email protected], by fax to 1-507-384-0024 or by regular mail to:

Claim forms can be downloaded here and must include a copy of your Final Settlement Statement showing that you paid the ABC Fee or Administrative Brokerage Commission. (A Settlement Statement is a list of items paid at the closing of your real estate and should list the ABC Fee.) If the fee was paid outside of Closing, you must attach a copy of the check you wrote to pay the ABC Fee.
