Quaker Oats No Preservatives Class Action Lawsuit Overview:
- Who: A Quaker Oats granola bar consumer is suing PepsiCo and Quaker Oats.
- Why: The consumer says the granola bars are labeled as having no preservatives; however, they contain tocopherols.
- Where: The class action lawsuit was filed in a Missouri federal court.
Quaker Oats granola bars claim they contain no artificial preservatives when in fact they contain the artificial preservative “tocopherols,” a new class action lawsuit alleges.
Plaintiff Robin Boone filed the class action complaint Jan. 27 against PepsiCo, Inc. and The Quaker Oats Company in a Missouri federal court, alleging violations of state and federal consumer laws.
She is looking to represent anyone who bought Quaker Oats Company-branded granola bars.
Boone alleges that the defendants “falsely, misleadingly and deceptively” market the granola bar products as containing “No Artificial Preservatives.”
“Contrary to these representations, the Products contain the artificial preservative tocopherols,” Boone says. “This labeling deceives consumers into believing that they are receiving healthier products that are free of artificial preservatives, but defendants’ products do not live up to these claims.”
According to Boone, tocopherols function as an artificial, chemical, and synthetic preservative has been well-documented.
“Defendants admit on the labels of the products that the tocopherols are an ingredient used ‘to preserve freshness’ in the products,” she says.
Plaintiff Says She Would Not Have Bought The Products If She Knew They Contained Tocopherols
Boone says she bought the products in reliance on the representations that they contained “No Artificial Preservatives” and would not have bought them if she knew the truth.
She says she wants to force Quaker to undertake a corrective advertising campaign and to provide consumers with monetary relief for its “deceptive and misleading product claims.”
She’s suing for violations of Missouri advertising laws, breach of warranty, unjust enrichment, negligent misrepresentation and fraud.
Boone is seeking certification of the class action, damages, fees, costs and a jury trial.
This is the latest in a string of class action lawsuits Quaker has faced over the years. In 2019, Quaker faced a class action lawsuit accusing the company of falsely advertising the health benefit statements made on its cereal and granola bars packaging.

Wood chips found in Quaker chewy chocolate chip granola bar.
I also swallowed wood chips from a Quaker Oats Granola bar. It actually was pretty painful and when I called Quaker Oats, they said that they would dissolve as I digest them and they couldn’t guarantee that they would pull them off the shelf even though I gave them the bar code and photos. So scary to think I was feeding those to my 3 year old!
