By Kimberly Mirando

Lucky Case GameDid you play the “Lucky Case Game” that aired on the television show “Deal or No Deal?” If you paid for premium text message charges in connection with entering the Lucky Case Game but did not win a prize, you may be able to receive a full refund of the charges you paid under a class action lawsuit settlement.

The Lucky Case Game settlement will resolve a class action lawsuit, entitled Herbert, et al. v. Endemol USA, Inc., et al., that alleges the game constituted an illegal lottery under California and Massachusetts law. The Defendants — Endemol USA, NBC Universal, Verisign, m-Qube and Don Jagoda Associates — deny any wrongdoing, but have agreed to provide refunds of all premium text message charges paid by Class Members who submit a valid claim form.

You’re considered a Class Member of the Lucky Case Game class action lawsuit settlement if you paid premium text message charges in connection with entering the Lucky Case Game promotion from December 2005 through January 2008 and did not win a prize. You are not a Class Member if you were not charged a fee for participating, or if you participated by entering online.

To receive your refund under the Lucky Case Game text contest class action settlement, you must submit a valid claim either online at www.LuckyCaseGameSettlement.com, through the mail or by calling the toll-free number (877) 248-5358. I’ve been on disability since I was 33 years old because of cancer and brain lesions. I’m 43 now and still on disability and I go in the hole in my bank every month trying to provide for my family. I could really use a chance at a break. I live in Pensacola. Florida and I’m a mother of 4 boys and 1 girl with 1 grand baby.
