Tampax lead class action lawsuit overview:ย

  • Who: Plaintiff Laura Willis-Albrigo filed a class action lawsuit against The Procter & Gamble Company.ย
  • Why: Willis-Albrigo claims P&Gโ€™s Tampax Pearl tampons contain unsafe levels of lead.ย
  • Where: The class action lawsuit was filed in California federal court.ย

A new class action lawsuit claims the Procter & Gamble Company sells a line of Tampax-brand tampons containing lead.ย

Plaintiff Laura Willis-Albrigoโ€™s class action lawsuit claims P&G falsely represents that its Tampax Pearl tampons are safe to use, despite the product allegedly containing unsafe levels of lead.ย

Willis-Albrigo argues independent laboratory testing found the Tampax Pearl tampons containedย  0.206 micrograms of lead.ย

โ€œThe vagina absorbs chemicals more easily than other parts of the body, and there is no safe level for lead,โ€ the Tampax class action says.ย

Willis-Albrigo wants to represent a nationwide class of consumers who purchased Tampax Pearl tampons for personal use, within the applicable statute of limitations period.ย

Class action says Tampax Pearl tampons misrepresented as safe to use

Willis-Albrigo argues P&G includes representations on the labels of Tampax tampons including โ€œALL DAY COMFORT AND PROTECTIONโ€ and โ€œOur best pearl protection everโ€ to give the impression its Tampax tampons are safe to use and will provide โ€œprotection.โ€ย

โ€œHowever, the Representations are false and misleading because the Tampons contain unsafe levels of lead,โ€ the Tampax class action says.ย

The class action lawsuit cites alleged statements from the World Health Organization, the U.S. Centers for Disease Control and Prevention and the U.S. Food & Drug Administration as proof that lead is a โ€œknown health hazardโ€ that โ€œposes a health threat.โ€ย ย

Willis-Albrigo claims P&G is guilty of breach of implied warranties and violating Californiaโ€™s Unfair Competition Law and Consumers Legal Remedies Act.ย

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of monetary damages for herself and all class members.ย

A consumer filed a pair of similar class action lawsuits against P&G and Kimberly-Clark Corp. at the end of July over claims the companies failed to disclose their respective tampon products contain unsafe amounts of lead.ย
