A new class action lawsuit accuses Primal Kitchen of falsely advertising its avocado oil as pure and non-GMO.

Plaintiff Caron James filed the Primal Kitchen class action complaint against Primal Nutrition LLC on June 6 in California federal court, alleging violations of state and federal consumer laws.

James alleges Primal Kitchen avocado oil is falsely advertised as pure and non-GMO, misleading consumers into believing they are purchasing a premium product.

The lawsuit claims the oil contains harmful phthalates, contradicting the “pure” label, and that the non-GMO claim is meaningless because there is no genetically modified version of avocado oil on the market.

Testing revealed phthalates in Primal Kitchen avocado oil, lawsuit claims

James alleges Primal Kitchen advertises its avocado oil as “pure” and “quality tested,” but testing from an EPA-accredited laboratory found phthalates at a concentration of 2,774 parts per billion.

Phthalates are known endocrine disruptors linked to reproductive problems and obesity, the lawsuit says. James claims the presence of phthalates makes the oil impure, contradicting the product’s labeling.

James argues that Primal Kitchen uses the non-GMO label as a marketing tactic to make its product appear superior to competitors. She claims consumers are willing to pay more for products labeled as non-GMO, believing they are healthier and better for the environment.

She also argues Primal Kitchen’s misleading labeling induces consumers to pay a premium for a product that is no different from other avocado oils on the market.

The lawsuit seeks to represent anyone in California who purchased Primal Kitchen avocado oil during the class period.

James is suing for violations of state and federal consumer laws and is seeking certification of the Primal Kitchen class action, damages, fees, costs and a jury trial.

A similar lawsuit filed earlier this year accuses Madhava Honey Ltd. of falsely advertising its olive and avocado oils as being “clean” when independent tests revealed they contained phthalates.
