A pressure ulcer lawsuit blames a facility for the bed sores developed by a resident. Bed sores are often a clear indication of nursing home abuse and neglect.
The personal representative of a now deceased resident of a facility has filed the pressure ulcer lawsuit against Vindobona Nursing and Rehabilitation Center and Grace Healthcare LLC. The plaintiff named in the pressure ulcer lawsuit was originally admitted to Vindobona around 2006 after having suffered a stroke.
The patient was 69 years old at that time with multiple medical diagnoses including dementia, depression, hemiplegia and depression. The pressure ulcer lawsuit says that the facility was aware of the patient’s medical condition and history and should have been mindful of the negative consequences of nursing home abuse and neglect.
The family members involved in the pressure ulcer lawsuit say that the they anticipated that the facility was able to monitor their family member and provide her with the rehabilitative, custodial and nursing care necessary to ensure that she had the highest level of functioning possible.
The pressure ulcer lawsuit alleges that the company represented to the family that this would be achieved and that at all times, properly trained staff members sufficient in line with what is necessary to take care of patients, would be available to supervise, care for, and monitor the situation.
The pressure ulcer lawsuit says that the bed sores initially occurred in August of 2015.
A pressure ulcer on the patient’s right heal allegedly progressed to a stage 4. The pressure ulcer lawsuit says that allowing the ulcer to get to this point was a clear indication of the failure on the part of the Vindobona staff to provide the patient with appropriate care related to her nutrition, hygiene, toileting, bed and chair mobility, hydration, pressure relief repositioning and turning.
In 2015, other pressure ulcers also developed on the lateral ankle and right medial ankle due to the alleged failure of the nursing staff. The pressure ulcer lawsuit says that the facility is responsible for failing to have appropriate staff reviewing their family member’s condition and moving the patient on a regular basis.
Pressure ulcers often develop on the body of a nursing home patient if he or she is not receiving proper attention and care. For those patients who are unable to move themselves regularly, it’s important for staff to check on the resident and regularly move the body so as to avoid serious issues with pressure ulcers.
If a pressure ulcer begins to develop, staff at the facility should be prepared to take extra precautions to ensure these don’t escalate to an advanced level. Advanced level pressure ulcers can be extremely painful for facility residents.
Anyone who may have seen a loved one deteriorate in medical condition significantly after the development of a pressure ulcer may be eligible to pursue a lawsuit against the responsible parties.
The Pressure Ulcer Lawsuit is Case No. 1:18-CV-01336-CCB in the U.S. District Court for the District of Maryland.
