Like most workers, Praxair trucking drivers are entitled to certain labor requirements like proper rest periods and meal breaks. According to reports, Praxair trucking drivers may not actually be receiving the breaks that they are entitled to under California labor law.
A class action investigation is now seeking drivers who work in Praxair trucking and have been denied meal or rest periods during their work shifts.
Praxair Trucking Basics
Praxair is a company that delivers various chemicals and industrial gasses to businesses all over the country. The products involved in Praxair trucking deliveries are hazardous, so the drivers are required to stay with their trucks at all times. While this is certainly a safety concern, as no one wants hazardous materials to be at risk of exposure, this practice may actually deny Praxair trucking drivers their legally required rest periods and meal breaks, which are an essential component of California labor law.
California Meal & Rest Periods
Non-exempt California workers are entitled to a strict set of rest periods and meal breaks during their work day.
Under California law, most workers are entitled to paid rest periods of at least 10 uninterrupted minutes. The number of rest periods per day is determined by the number of hours worked. A 3.5-hour shift requires one rest break. An additional rest break is added at 6 hours and 10 hours, respectively. On top of this, a worker can’t actually be required to work through or during their rest periods.
A 30-minute meal break is required during a five-hour shift, and another is added for a shift past 10 hours.
Former Praxair trucking drivers have claimed that they were required to work during rest periods and meal breaks and weren’t compensated for when they missed these required breaks.
Federal and State Wage and Hour Laws
There are a series of both federal and state wage and hour laws put in place to protect workers and ensure they are treated fairly. However, many workers do not know the protections that the Fair Labor Standards Act (FLSA) and California state law offer, which can lead to employers taking advantage of them.
Some workers may find themselves unable to file wage and hour complaints because they are not aware of the specifics of FLSA and California labor laws. Others may be afraid that their employers will retaliate or even fire them if they speak up about these kinds of labor violations. To protect workers who help to enforce labor laws, there are also regulations to protect workers from retaliation based on wage and hour complaints.
