A California man claims his use of Nexium 24HR led to stage 4 PPI gastric cancer.
Plaintiff Lamar S. and his spouse Linda N. allege that Lamar was exposed to an excessive risk of developing PPI gastric cancer and was not properly warned about that risk. The couple also claims Lamarโs use of Nexium 24HR caused him to develop acute kidney injury that required dialysis for treatment.
The PPI gastric cancer lawsuit says defendants Merck and AstraZeneca are responsible for a variety of different claims, including loss of consortium, economic loss, loss of services, and injury to the patient.
Lamar allegedly used the medications that led to PPI gastric cancer between January 2009 and July 2017.ย The product at issue is Nexium 24HR, an over-the-counter version of the prescription drug Nexium.
Lamar and Linda are raising several different claims against Merck and AstraZeneca, including breach of express warranty, strict product liability, failure to warn, design defects, negligence, negligent misrepresentation, and fraudulent concealment. Linda is raising a claim for loss of consortium, which is a type of claim that a spouse can bring to seek compensation for the affect of the alleged injuries on the coupleโs marital relationship.
The Nexium Multidistrict Litigation
Patients who have suffered a variety of different side effects have initiated lawsuits against the manufacturer of Nexium, claiming that they were never told about the dangers and risks and should have been informed in advance so that they could make an educated decision about whether or not to use the medication. Many of the patients claimed that they did not know about the risks until it was too late.

Lamar and Linda are unique in that they seek to hold the defendants accountable for a case of PPI gastric cancer. Most Nexium lawsuits in the MDL raise claims related to kidney function. Lamar and Lindaโs claim may be the first related to stomach cancer.
The development of PPI gastric cancer can be overwhelming, confusing and expensive.ย Limited treatment options may be the only choices available by the time a patient discovers that he or she is suffering from PPI gastric cancer.
