A recent lawsuit filed in the Benicar MDL asserts a link between the use of Benicar and psychological damage that allegedly resulted from the use of the drug.
Plaintiff Shirley T. filed a lawsuit against Benicar manufacturer Daiichi Sankyo in the current Benicar multidistrict litigation, or MDL, that is underway in federal court in New Jersey.
Shirley says she began taking Benicar in May 2007 to treat her high blood pressure.
As a result, Shirley claims that she suffered personal injury to herself including both psychological damage as well as physical damage.
Furthermore, Shirley alleges economic loss as the result of her mental and physical conditions.
Specifically, Shirley states she suffered from the following: “abdominal pain, nausea with vomiting, diarrhea, colitis, renal insufficiency secondary to dehydration, olmesartan associated enteropathy, severe mental and/or physical pain, economic loss, lost earnings and earning capacity, past present and future medical expenses, impairment, psychological damage, need for medical monitoring, pain and suffering, emotional distress, loss of enjoyment of life.”
Shirley has brought forth 15 counts against the manufacturers of Benicar including products liability for design defect and failure to warn, multiple counts of negligence and fraud, breaches of express and implied warranties, unjust enrichment, violation of California consumer protection laws, and punitive damages.
Shirley is seeking a trial by jury for economic and noneconomic damages of an unspecified amount, including compensatory damages, punitive damages, interest, costs of suit and any additional relief as provided by the Court.
Benicar and Psychological Damage
Due to the intense and severe physical side effects that some users of Benicar report experiencing, some of those patients report severe psychological damage.
As a medication used to treat high blood pressure, Benicar, for some people, causes more problems than it attempts to treat. Many patients have reported issues with gastrointestinal symptoms that mimic celiac disease, but they test negative for that condition.
Severe, unrelenting diarrhea, malabsorption of nutrients, malnutrition, dehydration, vomiting, inflammation of gastrointestinal organs and more are associated with the condition known as sprue-like enteropathy that is connected with Benicar use.
These issues can become so severe that patients require hospitalization to treat severe electrolyte imbalances and nutrition deficiencies that result.
Patients may go from having high blood pressure with little to no symptoms to nearly bedridden and unable to work or socialize outside their home due to the severe symptoms they experience.
They may have once felt like productive members of society, but due to their reaction to the side effects of the drug, their lives may have experienced a drastic change, causing psychological injury.
