A new class action lawsuit alleges Petco failed to properly secure and safeguard consumers’ personal information, leading to a data breach earlier this year.
Plaintiff Matthew Mack claims Petco failed to properly secure and safeguard personally identifying information of consumers, including names, dates of birth, Social Security numbers, driver’s license numbers, and financial information such as account numbers and credit or debit card numbers.
Mack argues Petco knew or should have known about the importance of safeguarding consumers’ personal information and the consequences of failing to do so.
“Petco failed, however, to take adequate cybersecurity measures to prevent the Data Breach from occurring,” the Petco class action lawsuit claims.
Mack wants to represent a nationwide class of consumers whose personal information was compromised in the Petco data breach.
Class action: Petco failed to notify consumers of data breach in timely manner
Mack claims Petco failed to notify consumers of the data breach in a timely manner, despite allegedly discovering it during a routine security review in July 2025.
“Plaintiff and Class Members were wholly unaware of the Data Breach for months until they received letters from Defendant informing them of it,” the Petco class action lawsuit says.
Mack claims Petco is guilty of negligence, breach of implied contract, breach of the implied covenant of good faith and fair dealing, and unjust enrichment and that the company violated the Declaratory Judgment Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and damages in an amount to be determined at trial for himself and all class members.
