Taxotere hair loss alopecia chemotherapyPermanent alopecia, or hair loss, from Taxotere breast cancer treatment, is alleged in a new lawsuit filed in a Louisiana federal court.

The plaintiff, Carmen R., claims that the use of Taxotere, or docetaxel as it is known generically, caused her to lose her hair and disfigured her for life. Taxotere is a chemotherapy drug most often used for metastatic breast cancer treatment.

Carmen claims that her injury via Taxotere breast cancer treatment occurred while she was living in Florida and Louisiana. She is a current resident of the state of Louisiana where the multidistrict litigation (MDL) No.2740 concerning Taxotere or docetaxel products liability litigation has been remanded by federal courts. Carmen’s claim officially joined MDL 2740 upon the date of its filing.

Carmen filed her case against the companies and related affiliates outlined in the long-form complaint filed in U.S. federal court on March 31, 2017.  The named defendants are Sanofi Inc., Sandoz Inc., Accord Healthcare Inc., McKesson Corp., Hospira Inc., Sun Pharmaceutical Industries Inc., and Pfizer Inc. and Actavis Inc.

According to her complaint, Carmen attempted to research the New Drug Application numbers of infused chemotherapy breast cancer treatment applicable to her case. The lawsuit reports that she was denied access to this information, and because of this denial, plaintiff has named all defendants participating in Taxotere market at the time of her breast cancer treatment. Carmen asserts that she has not been able to identify the exact form of Taxotere treatment for similar reasons.

Carmen’s breast cancer treatment occurred between November 2015 and September 2016. Carmen claims that she experienced a large amount of permanent hair loss with patchy minimal regrowth. She asserts that she has experienced spots of complete baldness, and where there is some regrowth the hair is extremely thin.

Carmen R. is bringing several of the counts listed in the long-form MDL against the defendants named in her case: Count One—Strict Products Liability, Failure to Warn; Count Three—Negligence; Count Four—Negligent Misrepresentation; Count Five—Fraudulent Misrepresentation; Count Six—Fraudulent Concealment; and Count Seven—Fraud and Deceit.

Carmen also reserves the right to invoke privileges of the laws of the state of Louisiana having to do with statute of limitations, discovery rule, and fraudulent concealment. She also asks for a trial by jury as indicated in the original MDL. Also, indicated in the lawsuits is a demand for compensatory and general damages according to the proof provided at trial, reimbursement for all attorney and court fees, as well as past and future medical costs.

Carmen asks the court consider her loss of earning power, lost wages, and emotional distress and trauma coming when calculating damages as a consequence of her permanent alopecia.
