pain-pelvic-meshA new pelvic mesh lawsuit has been filed by a Texas couple citing damages caused by the wife’s pelvic mesh procedure.

Plaintiffs Martha S. and James S. have filed a pelvic mesh lawsuit against Johnson & Johnson and Ethicon for their Gynecare Prolift Anterior Pelvic Floor Repair System (Gynecare System) that is designed to treat pelvic organ prolapse and urinary incontinence.

What is a Pelvic Mesh?

Transvaginal, or pelvic, mesh is most often made of polypropylene. The term “transvaginal” is used because the surgeon implants the mesh through the vagina.

This was created to permanently fix pelvic organ prolapse and stress urinary incontinence. These problems often bother women after a hysterectomy, menopause or childbirth.

Pelvic organ prolapse occurs when the muscles in a woman’s pelvis weaken and the bladder, rectum and/or uterus drop into the vagina. The can permanently fix this issue, but also may come with a host of problems such as mesh erosion and organ perforation.

Pelvic Mesh Lawsuit Filed by Texas Couple

The plaintiffs in this pelvic mesh lawsuit claim that Johnson & Johnson and Ethicon should have known that “the Gynecare System had been insufficiently tested; that it was defectively created, designed, manufactured, tested, and formulated; lacked adequate warnings; and was negligently and recklessly approved, advertised, marketed, promoted, and sold.”

The pelvic mesh lawsuit claims that the FDA issued a public warning about the risks associated with transvaginal placement of mesh devices, such as the Gynecare System and that they could potentially lead to serious complications including erosion of the mesh material, infection, bleeding, pain, organ perforation and urinary problems.

The defendants, according to Martha and James’ pelvic mesh lawsuit, knew about the risks and misrepresented them to the public and the medical community.

On February 7, 2007,  the Gynecare System was used to treat Martha’s symptomatic cystocele and stress urinary incontinence. After this procedure, she had to undergo an additional five revision surgeries to attempt to correct the problems with the defective mesh.

Those surgeries occurred between 2007 and 2014.

In her pelvic mesh lawsuit, Martha claims that she suffers from pain, urinary incontinence, erosion of mesh placed inside her, scarring and prolapse.

She has, as a result of the Gynecare System placed in her body, suffered damages including past and future physical pain and suffering, past and future emotional distress, past and future medical expenses and loss of enjoyment of life.

This pelvic mesh lawsuit brings claims of unreasonably dangerous composition and construction, unreasonable design, inadequate warning, breach of express warranty and loss of consortium.
