Patients who underwent artificial hip replacements with a device known as the DePuy ASR hip implant and had revision surgery may be eligible to take part in a settlement with the manufacturer in order to recover financial and other losses as a result of DePuy ASR hip implant failure.
The DePuy ASR hip implant was voluntarily recalled back in August 2010. Worldwide, approximately 93,000 of these hip implants were placed in patients, with about 37,000 of those being implanted into patients in the United States.
Like other metal on metal hip implants, the DePuy ASR hip implant has been implicated in a number of conditions that followed the implantation of the device. These conditions related to DePuy ASR hip implant failure include:
- Pseudotumor development surrounding the hip implant
- Cancer
- Hip dislocation
- Hip implant failure
- Cardiomyopathy
- Degenerative heart disease
- Tissue necrosis affecting tissue surrounding the implant
- Metal poisoning from cobalt or chromium
- Fractures of the bones surrounding the implant
Most hip implants are made with metal components, but they have a distinct difference from the DePuy ASR hip implant. Other brands of hip implants offer a liner that separates the metal components of the device. This allows the moving metal parts to have distance from one another and to not cause issues.
The DePuy ASR hip implants, on the other hand, metal pieces that touch, and this seems to be the catalyst for the various ways the DePuy ASR hip implant failure manifests.
When the metal parts touch, metal particles slough off and enter the bloodstream and surrounding tissue. When these cobalt and chromium metal ions move into the body in high concentrations, their presence can cause all sorts of problems from localized damage surrounding the hip to systemic organ damage if the metal debris enters the bloodstream.
Receiving a Settlement Following DePuy ASR Hip Implant Failure
A number of lawsuits have been filed against the manufacturer of the DePuy ASR hip implant, Johnson & Johnson, alleging the product is defectively designed and manufactured and caused a plethora of health problems in individuals. The lawsuits also generally allege that the manufacturer failed to warn patients and physicians of the possibility of issues related to its metal-on-metal design.
Johnson & Johnson has offered a settlement to patients who experienced the DePuy ASR hip implant failure and to have a revision surgery after March 2015. It is expected that plaintiffs will receive between $200,000 to $500,000 if they are eligible for the settlement.
If you or a loved one has suffered from DePuy ASR hip implant failure and you have had stem revision since March 2015, you may be eligible to take legal action against the manufacturer in order to recover your losses.
Successful claimants may be able to recoup economic and non-economic damages for situations like pain and suffering, past and future medical bills, loss of spousal companionship, wrongful death and more. Additional damages, known as punitive damages, may also be awarded in order to punish the manufacturer.
Navigating the process to take part in the settlement is complicated, and it is advised to have a DePuy ASR hip implant lawyer help you through the process to ensure you are able to get the appropriate compensation that is due to you.
