blood clotPennsylvania plaintiff Morine E. Carter is suing Bayer Pharmaceuticals for the injuries she allegedly sustained from ingesting Yaz and Yasmin birth control pills. Carter alleges that as a direct result of ingesting Yaz and Yasmin, she sustained serious blood clot injuries.

According to the Yaz lawsuit, Carter selected Yaz and Yasmin as her prescription birth control because of advertisements she had seen. However, on Dec. 18, 2007, Carter allegedly began suffering a series of Yaz side effects. Following a medical examination, she was diagnosed with arterial thrombosis in the proximal right subclavian artery and distal axillary brachial artery. She is reportedly still undergoing medical treatment for this condition, and will need extensive monitoring of these health complications.

Carter states that Bayer had the obligation to inform her of these potential Yaz side effects because she was relying on the given information at the time. Carter states that if she had known about this side effect, she never would have taken the medication. She is suing Bayer for being directly responsible for manufacturing, selling, developing and distributing dangerous drugs. The charges in the Yaz/Yasmin lawsuit include negligence, false advertising, concealing information and misrepresenting a product.

Overview of Yaz/Yasmin Complications

Yaz, manufactured by Bayer, was approved by the U.S. Food & Drug Administration (FDA) in 2006. Along with its older sister, Yasmin, it is one of the first drugs to use the fourth-generation progestin, drospirenone. Drospirenone is the primary hormone that composes Yaz and several other oral contraceptives manufactured by the pharmaceutical giant. Bayer is currently the only drug company in the United States that uses drospirenone. Bayer has boasted about this fact in the past, marketing their oral contraceptives as superior to other drugs available on the market.

Prior to the approval of drospirenone by the FDA in 2001, there were several studies conducted by Bayer, which suggested the hormone caused certain side effects that had not been seen in previous generations of progestin. One of these side effects included an increase in the potassium levels in the blood, which causes the blood flow to slow down, increasing the potential for blood clot complications. Since its release, there have been hundreds of Yaz injury reports submitted to the FDA.

Carter is seeking damages for pain and suffering, emotional distress, loss of enjoyment of life, medical expenses, punitive damages, attorney’s fees, and court costs. Her Yaz lawsuit has joined multidistrict litigation (MDL) that is currently underway in Illinois federal court.
