Novo Nordisk failed to warn consumers its weight loss drug Ozempic can cause a number of serious health issues, including gastroparesis, a new class action lawsuit alleges.
Plaintiff Diane Dyess filed the Ozempic side effects class action lawsuit Jan. 31 in Pennsylvania federal court, where it joins an existing multidistrict litigation centered on claims that Novo Nordisk’s glucagon-like peptide-1 receptor agonists (GLP-1 RAs) cause serious injuries, including gastroparesis.
The lawsuit claims Novo Nordisk failed to provide adequate warnings about the risk of gastroparesis and other adverse events allegedly associated with Ozempic, including gastrointestinal injuries, ischemic bowel, necrotizing pancreatitis, gallbladder disease, deep vein thrombosis, micronutrient deficiencies, Wernicke’s encephalopathy and aspiration of gastric contents.
It alleges Novo Nordisk engaged in deceptive and misleading marketing practices to promote Ozempic for weight loss despite the drug only being approved for the treatment of Type 2 diabetes.
“Defendants intentionally omitted other facts that they knew to be true from their labels, physician communications, marketing, website, public statements and other public facing communications,” the Ozempic lawsuit says.
Novo Nordisk failed to adequately warn of gastroparesis, class action claims
The Ozempic side effects class action argues Novo Nordisk’s marketing of Ozempic downplayed the risks of adverse events and failed to adequately warn health care providers and patients about the potential for serious complications.
The plaintiff claims Novo Nordisk’s marketing campaign for Ozempic was so pervasive it led to widespread off-label use of the drug for weight loss.
“Defendants’ aggressive marketing of Ozempic and other GLP-1 RAs created a perception that these drugs were a magic solution for weight loss, leading to increased demand and off-label use,” the Ozempic side effects class action says.
Dyess argues Novo Nordisk is guilty of negligence, failure to warn, strict liability, breach of express warranty, breach of implied warranty, fraudulent concealment, intentional misrepresentation, negligent misrepresentation, strict product liability misrepresentation, innocent misrepresentation, negligent design and strict liability design defect.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages for herself and all class members.
Last year, consumers hit pharmaceutical companies Novo Nordisk and Eli Lilly with a similar class action lawsuit alleging they failed to warn consumers about health risks associated with weight loss drugs like Ozempic.

I was taken ozempic and developed Gallstones and had to have them removed in July 2022 and it happened again in March 2025, and had Emergency Gallstone removal and then the Gallblader removal.
I. started having lots of gastrointestinal problems and developed gallstones which eventually led to having my gallbladder removed . I was constantly in the. emergency room due to pain from after having my gallbladder removed
I was using Ozempic. Started having stomach issues. Later found out my Gallbladder was messed up & had to have it removed.
I have been on Ozempic, for a year now and developed gallstones
