A new class action lawsuit alleges The Kraft Heinz Co. failed to disclose that certain Oscar Mayer turkey bacon products may be contaminated with listeria.
Plaintiff Steven Horne filed the class action complaint against Kraft Heinz on Aug. 25 in Florida federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, Kraft Heinz manufactures, markets and sells turkey bacon products under the Oscar Mayer brand.
However, Horne claims the company has inadequately and misleadingly labeled and marketed its turkey bacon products to reasonable consumers by failing to disclose on the packaging that the products may be contaminated with listeria monocytogenes.
Listeria can cause serious and life-threatening health issues, lawsuit says
Listeria monocytogenes is a pathogen that can lead to serious and life-threatening adverse health consequences, the lawsuit says.
The risk of severe infection poses significant concerns for pregnant individuals, infants, the elderly and those with compromised immune systems, the plaintiff claims.
The lawsuit claims consumers trust manufacturers like Kraft Heinz to sell products that are safe and free from known harmful substances, including listeria monocytogenes.
Horne alleges Kraft Heinz’s marketing and advertising campaign fails to disclose on the packaging the presence of listeria monocytogenes in the products.
“The knowledge of listeria monocytogenes is significant for reasonable consumers,” the Oscar Mayer class action says. “This information regarding the presence of listeria monocytogenes is exclusively within the defendant’s possession, and consumers would only be able to obtain it by sending the products to a laboratory for comprehensive testing.”
Listeria monocytogenes can survive refrigeration and freezing, making it a resilient and dangerous bacterium, the lawsuit explains.
Horne is looking to represent anyone who purchased the products anywhere in the United States during the class period. He is suing for violations of Florida’s Deceptive and Unfair Trade Practices Act, breach of warranty, negligent misrepresentation and unjust enrichment and is seeking certification of the class action, damages, fees, costs and a jury trial.
In 2024, an Illinois federal judge refused to dismiss a class action lawsuit against Kraft Heinz, which claims the company falsely marketed several Kraft macaroni and cheese products as free of artificial flavors, preservatives and dyes.

I cant wait til I can make a claim I purchased over 12 packages of the tainted turkey bacon from Walmart with the lot numbers on the packages.I used my online Walmart account to make the purchase They emailed me to not eat the bacon and throw it out they would refund me .They only refunded 4 packages and the other 8 they wouldn’t refund because they wanted me to go physically in the store and return them even though they credited me back the 4 packages .Litterly my online account shows all the purchases .Out of The first 8 packages 3 were eaten by ne and my son.I started buying turkey bacon due to my son and I eating healthier. I dont drive I am 55 and disabled that is why I used Walmart app to make the purchases for pick up and my neighbor got them for me with other groceries. During the time I was vomiting with fever and visited my local urgent care and we didn’t know what it was making me sick .They told me if fever was longer than week and vomiting and diarrhea continues to go to ER.Then a month later the Oscar Myer Turkey Bacon recall was emailed to me through my online Walmart account to get rid of or return the bacon it was included in the recall .If some one knows where to sign up for more information please let me know
