Unum Life Insurance Company of America is facing a new claim denial lawsuit, alleging the insurance company unfairly denied a cancer long term disability claim.
The claim denial lawsuit was filed by a man from Washington, who alleges he was wrongfully denied cancer long term disability coverage even though he met all eligibility requirements.
Plaintiff Dr. Randall M. says he needed cancer long term disability coverage for his treatments and other medical expenses which were compiling while he has been unable to work.
According to the claim denial lawsuit, Randall was fully employed as an Orthopedic Surgeon by Group Health Permanente and had paid the scheduled premiums to his disability insurance policy.
According to the terms of his insurance policy, Randall says he is eligible to receive long term disability benefits until he is 65 tears old. He says he applied for cancer long term disability coverage after suffering a number of serious side effects including weight loss, low energy levels, constant dry mouth and an atrial flutter.
Randall says he was diagnosed with tongue cancer and has undergone a number of different medical treatments that left him unable to work. He says he applied for cancer long term disability coverage under three different insurance policies on Jan. 13, 2015, and had stopped working two days later due to this condition.
According to the claim denial lawsuit, Randall was initially approved for long term disability coverage on April 2, 2015 but the payments stopped in March 2016 when he returned to work part time.
Unum reportedly received his cancer long term disability claims for partial or residual coverage, including gathering up information from different sources in an effort to help discredit the claims.
Based on these reviews, Unum reversed their cancer long term disability coverage despite the overwhelming medical evidence Randall provided in his application.
Overview of Disability Claim Denial
According to the claim denial lawsuit, Randall provided relevant medical documentation including two medical reports from his oncologist and radiation oncologist.
Upon receiving the claim denial letter, Randall reportedly started the appeal process immediately and started gathering medical testimony. According to a letter dated Nov. 21, 2017, Randall requested 45 days be given for the review period in order for him to gather relevant medical documentation.
After Unum approved this request, Randall had also arranged for his attorneys to provide financial information regarding his medical treatments to further emphasize his need for cancer long term disability coverage.
Even with all this medical testimony, Unum still reportedly denied the appeal in a letter dated Jan. 29, 2018. Randall filed legal action soon after that. Randall alleges that Unum committed bad faith insurance by acting on its behalf rather than their policyholder’s behalf.
At all times relevant, Randall says he provided sufficient proof of his disability including loss of significant income and inability to work. Even with all this documentation, Unum allegedly ignored this and chose to deny cancer long term disability coverage.
Randall is seeking damages for all missing cancer long term disability coverage, along with any other relevant damages.
