Yet another class action lawsuit settlement has been reached over mobile content providers placing unauthorized charges on customers’ cell phone bills.
If you received and paid for unauthorized charges for ringtones or other mobile content on your wireless bill at any time prior to September 13, 2010 from OpenMarket, Inc. or one of the following companies, you may be eligible to receive money from a pending class action lawsuit settlement:

Predicto Mobile, LLC (Celebrity Squares, LLC; TVTXtr, LLC and GuessSMS, LLC)

The Open Market settlement will resolve a class action lawsuit that alleges the companies listed above placed unauthorized charges for premium “mobile content” on wireless subscribers’ cell phone bills, including, but not limited to: ringtones, wallpaper, games, horoscopes, chat services, query services and news alerts. Any charges associated with the defendants would appear on your wireless statement along with the billing “short codes.” To determine whether you were charged for unauthorized mobile content under this settlement and are a member of the class, see the Settlement Administrator’s website.
The Open Market class action lawsuit is one of over 30 similar lawsuits filed against OpenMarket, the defendants and other companies pending in courts throughout the country. We told you about one recent class action lawsuit settlement last month.
If given final approval, the Open Market class action lawsuit settlement will provide class members two settlement options. The first option is to receive a set cash award of $10. This requires submitting simple information and verifying you received and paid for unauthorized content. The second option requires more detailed information about subscription and recurring charges, but will make you eligible to receive a cash refund of up to three months of such charges. The deadline to submit a claim form for either settlement option is March 1, 2011. The deadline to exclude yourself or to file an objection is December 20, 2011. A fairness hearing will be held January 14, 2011.
