old-spice-swaggerFive plaintiffs from three different states are claiming Old Spice deodorant is a defective product that caused painful damage to their skin.

Plaintiffs Dave Laiosa, Jose Toledo, Adrian McCoy II, Sylvia Anderson and Anderson’s unnamed son claim that Old Spice deodorant has been causing irritation, rashes and chemical burns on the skin of those who use it.

They accuse defendant Procter & Gamble Company, the maker of Old Spice, of marketing a dangerous product without properly warning consumers about the risks.

Anderson is participating in this Old Spice chemical burn class action lawsuit on behalf of her underage son. She says she bought Old Spice Swagger deodorant for her son sometime in 2015.

Then in February 2016, and after only a few applications of Old Spice deodorant, her son developed a painful rash with peeling skin under both arms, Anderson says. Treating her son’s injuries required application of cortisone cream and antibacterial soap, she claims.

The other plaintiffs describe similar experiences with Old Spice deodorant. McCoy says his injuries led to intertriginous dermatitis, which can lead to a bacterial or fungal infection at the site of broken skin.

Some plaintiffs say when they complained to Procter & Gamble about the damage to their skin, the company offered them nothing but coupons for more Old Spice deodorant.

In addition to the physical harm to their bodies, plaintiffs say they were also injured economically because they did not get the useful product they paid for. Because they were unable to use their Old Spice deodorant for its intended purpose, they say, they had to discard the remaining product after only a few uses.

This Old Spice deodorant class action lawsuit follows on the coattails of others like it. In March 2016, plaintiff Rodney Colley of Ohio claimed he developed a severe rash despite assurances on Procter & Gamble’s website that Old Spice deodorant had “no known effect” as far as skin irritation was concerned.

Colley’s claims were dismissed later that October, though the court granted him leave to amend his complaint to fix its defects.

Plaintiffs in this current class action lawsuit want the court to compel Procter & Gamble to disclose all documentation in its possession –reports, studies, analyses, and the like – dealing with the health and safety effects of Old Spice deodorant. They seek to compel the company to engage in a corrective advertising campaign.

They are also asking the court to award damages, restitution and disgorgement of profits, court costs and attorneys’ fees, and any other relief the court sees fit to grant.

The plaintiffs are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group PLLC.

The Old Spice Deodorant Chemical Burn Class Action Lawsuit is Dave Laiosa, et al. v. The Procter & Gamble Company, Case No. 7:17-cv-00441, in the U.S. District Court for the Southern District of New York.
