Old Orchard Juice Class Action Settlement

Old Orchard Brands has reached a class action lawsuit settlement for misrepresenting that its juice products were made of “100% Juice.” As a result, California consumers can receive a $0.50 instantly-redeemable coupon for “Old Orchard Products” purchased at certain stores.
The Old Orchard juice settlement will resolve a class action lawsuit, entitled Micheal Mathias v. Old Orchard Brands, LLC, that alleges Old Orchard Brands made false and misleading claims in their packaging, labeling and/or promotion of their products by not prominently disclosing that its Old Orchard 100% Juice products do not, in fact, contain 100% juice.
As part of the Old Orchard class action settlement, Old Orchard will issue $0.50 in-store rebate coupons for “Old Orchard Products” sold in California that will be immediately redeemable upon purchase of an “Old Orchard Product” within a 120-day period following the Effective Date of the settlement.
The Old Orchard coupons will be distributed at Save Mart Supermarkets and Grocery Outlet — two of Old Orchard’s primary retail outlets in California. In addition, Old Orchard will also make changes to its juice product labels that more clearly indicate that the Old Orchard Products are a blend of multiple juices, not just those named on the front label of the product.
California consumers do not need to do anything to participate in the Old Orchard juice settlement; they will automatically receive the rebate coupon when they purchase an Old Orchard juice product during the applicable period. However, if you wish to object to the settlement or exclude yourself, you have until September 28, 2011 to file your objection or request for exclusion.
