Nursing facility abuse is a serious concern throughout the United States, with millions of elders vulnerable to neglect of staff members at these locations. In a recent case highlighting nursing facility abuse, a brother and sister have filed legal action against Camarillo Healthcare Center after discovering their mother had a bedsore the “size of a baseball.”
The siblings allege the nursing facility abuse was life threatening, based on the state of their mother when they removed her from the elderly care facility in 2015. They also allege the staff’s neglect had caused the “baseball” sized bedsore to form, and that they were relying on Camarillo Healthcare Center to help their mother recover from a serious fall she had sustained in late 2014.
Even though the bedsore was quite substantial, with most jurors reportedly shocked when presented with video evidence, the nursing home staff had a different perspective. One of the Camarillo nurses, Mary Ransbury, testified for the nursing home and stated she not only treated such wounds on a regular basis but that she believes the plaintiffs’ mother received proper care.
The siblings ultimately decided to file legal action on her behalf, stating “they would have literally killed her there” in their lawsuit. This nursing facility abuse lawsuit is being filed on behalf of Linda K., with her daughter and entertainment television reporter Renee E. and her son Hideichi K.
The defendants named in the claim is Camarillo Community Healthcare, the Ensign Group, and other subsidiaries.
Overview of Nursing Facility Abuse Lawsuit
According to the nursing facility abuse lawsuit, Camarillo Healthcare Center promised Renee that her mother would be well taken care of when she was admitted to the facility in December 2014.
Her mother suffered a stroke 20 years earlier, but had to be admitted to the nursing home after falling and hitting her head. Renee says she was repeatedly told that her mother would receive “excellent” care, and the staff would attend to her needs.
However, when Linda was removed from the nursing care facility and transferred to the Community Memorial Hospital, she was diagnosed with a stage IV pressure ulcer. The plaintiff’s lawyers noted that the bedsore would have healed if Linda had been able to move and was not stranded in her own waste for long periods of time.
Even though their mother had sustained serious injuries due to the alleged nursing facility abuse, Linda recovered well by June 2015 and is currently under her son’s care. At this point in time, the attorneys involved in the nursing facility abuse lawsuit have given their final arguments and a Los Angeles Superior Court jury has begun deliberations.
Not all elderly residents in nursing home facilities get recourse for the neglect inflicted upon them. Oftentimes nursing homes are understaffed and are not prepared to give the necessary care to the residents.
This was also allegedly the case with Camarillo Healthcare, with the plaintiff’s lawsuit alleging the nursing home did not have enough staff members ultimately contributing to the nursing facility abuse.
In general, nursing home neglect lawsuits are filed individually by each plaintiff and are not class actions.
