Kitchenware retailer Nordic Ware falsely advertises its aluminum bakeware as being made in the United States, a new class action lawsuit alleges.
Plaintiff Michael Kaufmann claims Nordic Ware markets its aluminum bakeware as “made in the USA” despite using foreign-sourced aluminum in its products.
Kaufmann argues the company’s advertising, which includes using images of the American flag, is misleading to consumers who prefer to buy American-made goods.
“The USA Representations lead reasonable consumers, like Plaintiff, into believing the Products are ‘made in the USA,’” the Nordic Ware class action states.
Kaufmann seeks to represent a nationwide class and New York subclass of consumers who purchased Nordic Ware aluminum bakeware labeled as “made in the USA” within the applicable statute of limitations.
Aluminum in Nordic Ware bakeware sourced from Canada, class action claims
Kaufmann argues the aluminum used in the Nordic Ware bakeware is sourced from Canada, and the raw material for aluminum, bauxite, is primarily imported from countries like Australia, Guinea, India, Brazil and Jamaica.
“Without aluminum (and bauxite) sourced from outside the United States, Defendant would not be able to manufacture its Products, all of which are aluminum based,” the Nordic Ware class action argues.
The lawsuit cites Federal Trade Commission guidelines, which state that products marketed as “made in the USA” should be “all or virtually all” made in the United States.
Kaufmann claims Nordic Ware is guilty of fraud and false advertising and of violating New York General Business Law and the Minnesota Prevention of Consumer Fraud Act.
The plaintiff demands a jury trial and requests declaratory relief and an award of compensatory and statutory damages for himself and all class members.
A separate class action lawsuit involving kitchenware was filed against SharkNinja Operating LLC in November 2024 over claims the company misrepresented that its NeverStick Premium Cookware products never stick, chip or flake.
