A new class action lawsuit alleges Nood Ventures LLC misrepresents the prices of its products on its website by falsely advertising them as being on sale.
Plaintiffs Tiffany Tran and Kasandra Hill filed the class action complaint against Nood on Jan. 9 in a California federal court, alleging violations of state and federal consumer laws.
Nood sells and markets skin care and hair removal products online through its website, where it sometimes lists various items on sale or discount, and shows a stricken “former” price next to the current supposed “sale” price.
However, the former price listed next to the sale price is not the actual price at which the product was sold in the previous three months, the lawsuit alleges. Instead, it is a false or inflated price used to trick consumers into believing they are receiving a discount on their purchase, the plaintiffs say.
“Plaintiffs—like other customers across the United States—fell prey to Defendant’s false, deceptive and misleading discount scheme,” the lawsuit states. “As a result, Defendant has earned money selling products at misrepresented discounts that do not actually exist.”
Nood’s conduct violates state, federal consumer laws, plaintiffs say
The plaintiffs claim Nood’s conduct violates California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act. They say Nood’s conduct also constitutes negligent misrepresentation and has unjustly enriched the company through the sale of its products.
As a result, the plaintiffs are looking to represent a California class of consumers who purchased one or more items from trynood.com at a represented discount from a higher reference price.
The plaintiffs are suing for violation of California consumer laws and seek class action certification, damages, restitution, fees, costs and a jury trial.
In 2024, consumers filed a host of similar class action lawsuits against Lowe’s Home Centers, L.L. Bean, Under Armour and Sleep Number Corp alleging the companies advertise false discounts to trick consumers into believing they are getting a better deal than is actually the case.
