A Florida woman alleges in a new Yaz lawsuit filed against Bayer Healthcare Pharmaceuticals that she suffered a permanent disability due to a stroke that was caused by Yaz blood clots.
Yaz lawsuit attorneys for Victoria Lynn Nichols Shearer note that she began taking the birth control pill in 2001 and suffered blood clotting that caused brain damage on Nov. 13, 2009. She was unaware of the possible link between the blood clots and her birth control pills, so Shearer continued using Yaz until nearly one year later, stopping on Sept. 26, 2010. The Yaz lawsuit was filed directly into MDL No. 2100, In Re Yasmin and Yaz (drospirenone) Marketing, Sales Practices and Relevant Products Liability Litigation.
The complaint alleges that Bayer concealed risks regarding the possibility of blood clotting issues for the fourth-generation contraceptives, although Yaz side effects reports indicated that there was a statistically significant increase in adverse event reports compared to older oral contraceptive classes. In addition, the pharmaceutical firm allegedly “ignored the correlation between the use of YAZ/Yasmin and the increased risk of developing thromboses, despite the wealth of scientific and medical evidence available.”
It is now believed that blood clotting and other issues are caused by increases in potassium levels, known as hyperkalemia that can lead to small heart arrhythmias that can lead to cells joining to each other. Bayer should have conducted testing that would have demonstrated the potential for these Yaz side effects, according to the complaint, but the company allegedly did not do so. As a result, thousands of women suffered from pulmonary embolisms, deep vein thrombosis and other conditions according to the U.S. Food and Drug Administration’s Adverse Event Reporting System.
The Yasmin blood clot lawsuit is Victoria Lynn Nichols Shearer v. Bayer Healthcare Pharmaceuticals, Inc. et al., Case No. 13-cv-10891, U.S. District Court, Southern District of Illinois. Counts against the company include negligence, strict products liability and breaches of warranties among others.
