A resident of Washington state recently filed a lawsuit against Atrium Medical over his hernia mesh implant, which he claims is defective and caused serious injuries.
The plaintiff, Bernard H., was implanted with a hernia mesh device on Sept. 9, 2010. Unfortunately, in the following months and years, Bernard alleges that he began experiencing serious complications as a direct result of the hernia mesh implant being defective. He claims that because of the mesh product, he suffered pain, infections and bowel obstruction.
These complications allegedly required him to undergo revision surgery to remove the hernia mesh device. Bernard had his hernia mesh device explanted on Sept. 22, 2015.
The specific hernia mesh product involved in Bernard’s lawsuit is the Atrium C-Qur. Bernard chose to file his lawsuit over the hernia repair mesh, alleging he was not adequately warned about the side effects of the device.
Bernard filed his hernia mesh lawsuit on Nov. 28, 2017 in the U.S. District Court for the District of New Hampshire. The lawsuit was filed on multiple counts, including negligence, design defect, manufacturing defect, failure to warn, breach of express and implied warranties, fraudulent concealment and gross negligence, among several others.
Hernia Mesh Background
Hernia mesh devices like the C-Qur from Atrium Medical have been used to repair hernias for more than half a century. Unfortunately, some hernia mesh products have been linked with very severe complications, causing injuries and sometimes requiring additional surgery.
Atrium’s C-Qur hernia mesh was recalled in an FDA Class 2 device recall in July 2013, which affected thousands of devices.
Hernia Mesh Complications
Patients have reported experiencing a number of serious problems with hernia mesh, including with the Atrium’s C-Qur product. Side effects linked with these hernia mesh devices include the following:
- Chronic pain
- Hernia recurrence
- Rejection of the mesh
- Infection
- Device migration
- Scarring
- Inflammation
- Organ adhesion
- Erosion
- Tissue and nerve damage
- Death
More common problems with hernia mesh, such as device migration, can later lead to much more serious complications like infection, adhesion, and device failure.
In many cases, hernia mesh side effects are severe enough that they may require revision surgery to remove the device completely and alleviate complications. Hernia mesh revision surgery, of course, brings with it its own risks as well as additional medical expenses.
