A Pennsylvania man has filed a new lawsuit against DePuy alleging that his DePuy Pinnacle hip replacement was defective, leading to serious complications.
The plaintiff, Donald A., was implanted with a DePuy Pinnacle hip replacement in a total right hip procedure on Oct. 12, 2010. Then, in July 2011, Donald underwent a second DePuy Pinnacle hip replacement in his left hip.
However, in the years following these procedures, Donald began experiencing increasingly more severe side effects, including inflammation, discomfort, and chronic pain. As a result of these complications, Donald underwent revision surgery for the DePuy Pinnacle hip replacement devices in 2015 and 2017.
According to the lawsuit, the DePuy Pinnacle hip replacement was defective, leading to these complications. The lawsuit, along with countless others like it, alleges that DePuy was aware of its product’s serious defects yet continued to market the device as safe and effective, failing to warn consumers of these risks.
Donald filed his DePuy Pinnacle hip replacement lawsuit on Feb. 16, 2017, in the U.S. District Court for the Northern District of Texas. The lawsuit was filed on multiple counts, including negligence, failure to warn, manufacturing defect, design defect, negligence misrepresentation, breach of express and implied warranties, and fraud.
The DePuy Pinnacle Hip Replacement
The DePuy Pinnacle hip replacement device was released onto the market back in 2001 and was intended to replace hip joints damaged by certain conditions. The DePuy Pinnacle hip replacement device is a popular hip implant option widely used across the country.
Indeed, almost 150,000 people have gone through a total hip replacement with this particular system, according to DePuy. Unfortunately, this widespread usage of the DePuy Pinnacle hip replacement means that any defects have the potential to affect a large number of patients.
The DePuy Pinnacle hip replacement has been linked to a number of serious problems, including metallosis, toxicity, and a high failure rate.
Thousands of lawsuits have been filed so far over serious problems with the DePuy Pinnacle device. Australia has even responded by taking the DePuy Pinnacle hip replacement off its medical market because of the high rate of failure.
Filing a DePuy Pinnacle Hip Replacement Lawsuit
Lawsuits claim that DePuy failed to adequately warn the public and the medical community about the risks associated with the DePuy Pinnacle hip replacement device. Had the plaintiffs been adequately informed of these risks, lawsuits claim, they may not have had the device implanted in the first place and could have avoided these painful hip replacement problems.
If you or someone you love has experienced hip replacement problems due to a hip replacement with something like the DePuy Pinnacle hip replacement, you may be able to file a lawsuit. Filing a lawsuit cannot take away the pain and suffering caused by device defects, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The DePuy Pinnacle Hip Replacement Lawsuit is Case No. 3:18-cv-00389-K, in the U.S. District Court for the Dallas Division of the Northern District of Texas.
