Diabetes ketoacidosis kidney medical recordYet another Jardiance lawsuit has been added to the growing number of diabetes drug suits over serious complications associated with the drug. Diabetes drug lawsuits like these have been filed against a number of pharmaceutical companies over a variety of medications, including Jardiance.

The Texas plaintiff, Luz L., began taking Jardiance at the direction of her doctor in order to treat diabetes back in July 2015. Although Jardiance was marketed as safe and effective for this use, Luz says, she had only used the medication for five days before beginning to suffer from some serious complications, including diabetic ketoacidosis symptoms. In response to these injuries, Luz has chosen to file a Jardiance lawsuit against the drug’s manufacturer, Boehringer Ingelheim Pharmaceuticals.

According to Luz’s Jardiance lawsuit, her diabetic ketoacidosis and subsequent visit to the intensive care unit was a direct result of the use of Jardiance. She immediately discontinued her use of Jardiance.

The Jardiance lawsuit was filed on multiple counts, including design defect, failure to warn, negligence, breach of express and implied warranties, negligent misrepresentation, and fraud, among several others.

Jardiance Basics

Jardiance (empagliflozin) is a diabetes drug manufactured by Boehringer Ingelheim and approved by the U.S. Food and Drug Administration (FDA) in July 2014. Jardiance is one of a group of relatively new diabetes drugs known as sodium-glucose cotransporter 2 (SGLT2) inhibitors. Other diabetes drugs in the same class include Invokana and Farxiga.

While Boehringer Ingelheim markets Jardiance as a safe and effective diabetes treatment, a growing number of reports suggest that Jardiance is actually linked with certain major side effects, including diabetic ketoacidosis.

The FDA is aware that certain type-2 diabetes medications like Jardiance may be able to increase a patient’s risk of injuries, such as heart failure or diabetic ketoacidosis. The federal agency is currently investigating whether or not it is necessary to make changes to the drugs’ labels to warn about these risks.

Though the drug has only been in use for a few years total, a growing number of consumers are already turning to litigation. Plaintiffs who have filed a Jardiance lawsuit like Luz or a lawsuit over another diabetes drug hope to gain some kind of financial compensation for the physical, emotional, and financial pain they have suffered because of the diabetes drugs’ side effects.

According to these lawsuits, if the manufacturers of these drugs had adequately warned the public and the medical community of the increased risk of ketoacidosis complications linked with their products, patients would not have used these medications and avoided serious injury. The diabetes drugs lawsuits allege that patients would have chosen a substitute, non-SGLT2 inhibitor medication rather than take on an increased risk of complications like ketoacidosis.

Filing a Jardiance Lawsuit

A growing number of patients are pursuing diabetes medication lawsuits after suffering from Jardiance diabetic ketoacidosis and other kidney problems.

If you or someone you love has suffered from significant side effects of Jardiance or other diabetes drugs, you may be able to file a Jardiance lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by Jardiance diabetic ketoacidosis, it can help to alleviate the financial burden incurred by medical expenses and lost wages.

The Jardiance Lawsuit is Case No. 5:17-cv-00728-DAE, in the U.S. District Court for the Western District of Texas.

In general, diabetes drug lawsuits are filed individually by each plaintiff and are not class actions.

Started Jardiance last July. About six weeks later I developed an ulceration on my left big toe. The infection entered the bone, my toe was amputee. Two weeks later I developed a quarter size ulceration on the bottom of my foot, within a week of that I developed another quarter size ulceration on my thigh, a ulceration on the tip of another toe. Three medical providers stated that was beyond coincidence. I’ve never had ulceration before I started Jardiance. ??
