Stryker hip implant LFIT V40 left hip X rayA new Biomet hip replacement lawsuit is joining growing multidistrict litigation (MDL), consisting of claims alleging serious metal hip implant complications.

This Biomet hip replacement lawsuit is being filed by a Florida couple, with the wife alleging the manufacturer failed to warn her and her physician that the metal on metal hip implant could cause permanent injuries.

Plaintiffs Ellen C. and Leonard C. are conjointly filing this Biomet hip replacement lawsuit claiming the metal-on-metal hip implant permanently impacted their marriage. As with numerous other claimants, Ellen’s physician recommended the Magnum metal hip implant after reviewing marketing materials provided by the company.

These marketing materials advertised the device as a superior product, and that they would be a good choice for Ellen’s condition, her lawsuit claims. With these benefits in mind, Ellen says she underwent total left hip replacement surgery on Sept. 9, 2009 with no initial complications.

However a few years after the implant surgery, Ellen reportedly begun experiencing complications like debilitating pain, discomfort, and soreness. According to the Biomet hip replacement lawsuit, Ellen’s daily life had been severely impacted and had trouble with limited movement.

Given the severity of the complications, Ellen underwent revision surgery on her left hip on Nov. 14, 2016. During this procedure, she says the Magnum device was explanted and replaced with different hip implant components.

According to the Biomet hip replacement lawsuit, this was necessary because the all-metal Magnum hip implant components had created and corroded due to metallosis. Metallosis is a condition that occurs when metal ions in the blood rises to dangerous levels, which is a common often associated with metal on metal hip implants.

This occurs when the all metal ball and socket joint components interact and shed into the bloodstream, which can lead to a number of other complications including but not implied to:

  • Fretting
  • Corrosion
  • Debilitating pain
  • Formation of pseudotumors
  • Infection
  • Inflammation

These metal hip implant complications often force patients to undergo revision surgery, which is considered riskier than the initial implant surgery.

Overview of Metal Hip Implant Problems

When metal-on-metal hip implants were first released to the market, they were thought to be overtly superior to plastic and ceramic models for being longer lasting and more durable. This made metal hip implants very popular for younger patients looking to live more active lifestyles, with most companies making these models customizable for patients.

Like many other metal-on-metal hip implants, the Magnum hip replacement system was recommended to patients suffering from osteoarthritis and similar conditions. However, numerous patients have reported serious metal hip implant complications, resulting in the litigation movement against Biomet.

Ellen states she would never have agreed to have the Magnum hip replacement system implanted if she had known the severity of metal hip implant complications. Ellen and Leonard’s Biomet hip replacement lawsuit is in MDL No. 2391, where it will be streamlined through the litigation process.

Ellen and Leonard are seeking multiple damages against Biomet including negligence and failure to warn, along with loss of consortium.

This Biomet Hip Replacement Lawsuit is Case No. 3:18-cv-00218-RLM-MGG, in the U.S. District Court of Northern Indiana, South Bend Division.
