Plaintiff Betty G. is filing this Atrium C-Qur lawsuit alleging there were no warnings or precautions against potential infection. Betty says she had the C-Qur Mesh V-Patch implanted for typical treatment purposes on May 17, 2013, and was under the impression it was safe and effective treatment for hernia repair.

She alleges neither she nor her physician had reason to believe the product would not work as marketed, or to think that there were chances of serious complications. At all times relevant, Betty says she used the hernia mesh product for its intended purpose and did not deviate from surgical instructions.

Even with her diligence, Betty says she later suffered hernia mesh complications including sinus tracts, infection, abscess formation, and inflammation. According to the Atrium C-Qur lawsuit, Betty eventually had to undergo revision surgery on Sept. 9, 2015 to treat her hernia mesh complications.

Overview of Hernia Mesh Complications

Atrium Medical Corporation is facing a growing multidistrict litigation (MDL) consisting of hernia mesh claims from patients like Betty.

Surgical mesh has been used for hernia repair for decades, with companies competing in the market space for years. Like many other hernia mesh products, the C-Qur Mesh V-Patch is made from a polypropylene material that is designed to deliberately induce inflammation.

This is because inflammation encourages tissue growth around the surgical area, which is supposed to solidify the hernia repair. While the inflammation is supposed to dissipate over time, some patients report the inflammation did not subside.

In these cases, infection can develop and cause abdominal pain and tenderness. When hernia mesh infection occurs, colonies of bacteria called biofilms can form. Since biofilms are resistant to antibiotics, hernia mesh removal is necessary to resolve this complication.

Other patients allege the C-Qur Mesh V-Patch coating, which consists of omega-3 fatty acids, may provoke an adverse immune reaction in the body. This often creates the need for hernia mesh revision surgery, with the patient often suffering from flu like symptoms.

Patients and doctors should be vigilant for any early signs of hernia mesh infection, such as lack of healing around the incision and warmth radiating from the surgical site. In addition, patients can develop flu-like symptoms and dental problems in cases of hernia mesh infection.

Even though these hernia mesh complications can be devastating, patients like Betty allege Atrium Medical Corporation failed to give them and their physicians an adequate warning. Betty is filing her Atrium C-Qur lawsuit in MDL No. 2753, where it will stand alongside other claims alleging similar injuries.

By joining the MDL, Betty’s Atrium C-Qur lawsuit will be streamlined through the litigation process and will avoid potential problems like conflicting rulings from different judges. Betty states she would not have opted for the C-Qur Mesh V-Patch if she had known about potential infection and need for revision surgery.

This Atrium C-Qur Lawsuit is Case No. 1:17-cv-00564-LM, in the U.S. District Court for the District of New Hampshire.
