NCO Financial Systems Call Recording Class Action Lawsuit

NCO Financial SystemsA federal class action lawsuit claims debt collector NCO Financial Systems Inc. illegally records cellphone conversations during which personal finance and other sensitive information is discussed without first obtaining their consent.

Plaintiff Mert Erel alleges in the class action lawsuit that he was contacted by NCO in July about an alleged debt the company was attempting to collect from Erel. After speaking with NCO for a period of time about “highly personal and private financial information,” including his home address and social security number, Erel asked if the conversation was being recorded. According to the class action lawsuit, the customer service rep responded for the first time that NCO records all calls it makes to consumers.

“Plaintiff was shocked to discover that such a confidential communication was being monitored, recorded and/or eavesdropped by defendant without plaintiff’s knowledge or consent,” the class action lawsuit states.  

Erel is seeking to represent all California consumers who received cellphone calls from NCO that were recorded without their consent within the past year. It is seeking statutory damages of $5,000 per violation or three times the actual damage per violation, in addition to injunctive relief and damages.

The NCO Call Recording Class Action Lawsuit case is Erel v. NCO Financial Systems Inc., Case No. 13-cv-00317, U.S. District Court for the Southern District of California.

    Hi: If NCO or anyone else for that matter is calling you on your cell phone that you never authorized them to call your cell phone number, call me and I’ll get you to the law firm doing that class action. 203-458-1200. It’s illegal to do this and you can get up to $1500.00 per call violation. Keep your recordings and keep good note of who, from where and when,

    they do it to me in ,Michigan ALL the time, never said to me they were recording the call,not even when they call my Magic jack number which is viop

    I use to work for that company and they are supposed to announce that the call is recorded, but most will never say that due to the amount of hang ups for saying so.. NCO rarely enforces the law. I hope this opens up to all states.

    I received phones calls from them also in Atlanta, Ga. this company can be very annoying……. this would be great if all states of the U.S. was involved cause you know if they recorded one they recorded all!!

    I noticed they never mentioned they were recording the conversation also. I also disputed a debt and provided proof and they reported to credit account anyhow!

    WOW, I JUST GOT ANOTHER CALL FROM THEM TODAY!
    800 735 6588 WAS THE NUMBER ON MY CALLER ID AT 12:25 THEY CALL EVERY WEEK, WHERE DO I PUT MY CLAIM IN???
