A new class action lawsuit alleges Navitas Organics failed to disclose that its chia seeds were contaminated with Salmonella.
Plaintiff Jennifer Soumekh filed the class action complaint against Navitas LLC on Feb. 11 in New York federal court, alleging violations of state and federal consumer laws.
According to the class action lawsuit, Navitas Organics deceptively marketed and sold its “Organic Chia Seeds” without disclosing the risk of Salmonella contamination, a bacteria that can cause serious infections.
The lawsuit claims that Navitas Organics issued a voluntary chia seed recall on Jan. 23, 2026, due to potential Salmonella contamination.
The recalled products were distributed nationally through major retailers like Whole Foods Market and Target as well as online platforms, such as Amazon, iHerb and Vitacost.com, the lawsuit says.
Despite the recall, Soumekh alleges that the company failed to adequately warn consumers about the contamination risk.
Navitas Organics chia seeds were marketed as safe, lawsuit claims
Soumekh claims she purchased the recalled chia seeds in January 2026 from Whole Foods Market in Manhasset, New York, for approximately $7.59.
The Navitas chia seed recall affected seeds sold in 8-ounce bags with a “best if used by” date of April 2027 and a lot code of W31025286.
She claims Navitas Organics’ marketing and advertising campaign failed to disclose the risk of salmonella contamination, leading consumers to believe they were purchasing a safe product. The class action lawsuit alleges that Navitas Organics marketed the chia seeds as safe and of high quality, emphasizing that the products were USDA Organic, non-GMO and gluten-free.
Soumekh claims she would not have purchased the chia seeds, or would have paid less for them, had she known about the Salmonella risk.
She claims that the company’s marketing and labeling misled consumers into believing the chia seeds were safe for consumption, when in fact they were contaminated with a dangerous bacterium.
The lawsuit alleges that Navitas Organics violated New York’s General Business Law and breached its warranties regarding the product’s safety.
Soumekh is suing on behalf of all consumers who purchased the recalled chia seeds and is seeking monetary damages, as well as restitution and disgorgement of profits.
In another Salmonella-related lawsuit, a customer is suing Costco for selling its $4.99 rotisserie chickens with knowledge they were “plagued with Salmonella”.
