A new class action lawsuit claims Nature’s Garden misrepresents its Yoggies product as being coated in yogurt.

Plaintiff Barbara Seaman alleges New Cibo Vita LLC falsely advertises the Nature’s Garden Yoggies product as being coated in yogurt, when it is actually coated in sugar and palm oil.

Seaman claims she purchased the Nature’s Garden Yoggies product based on its label, which describes it as “Real Fruit Pieces” that are “Coated By Creamy Yogurt.”

Seaman argues New Cibo Vita misleadingly advertises the Nature’s Garden Yoggies product as being coated in yogurt to appeal to consumers who understand yogurt to be beneficial to digestive health.

Class action: Nature’s Garden Yoggies product contains ‘de minimis’ amount of yogurt

Seaman claims the Nature’s Garden Yoggies product is actually coated in the equivalent of a “candy coating” that has only a “de minimis” amount of yogurt, which she argues is shown by the ingredient list on the back of the product’s packaging.

“Though purchasers realize they are not buying ‘yogurt,’ of the type eaten with a spoon, they expect it have more than a de minimis amount of yogurt, and/or to contain only or mostly yogurt as part of its coating, instead of a ‘candy coating,’” the Nature’s Garden class action lawsuit says.

Seaman claims she would not have paid as much as she did for the Nature’s Garden Yoggies product had she known it did not contain more than a “de minimis” amount of yogurt and was mostly covered in a “candy coating.”

Seaman claims New Cibo Vita is guilty of violating New York’s General Business Law. She demands a jury trial and requests declaratory and injunctive relief and an award of actual damages for herself and all class members.

A separate Nature’s Garden class action lawsuit alleges misrepresentations about the probiotics and artificial ingredients in its Probiotic Strawberry Yoggies and Mixed Berry Yoggies.
