Nabisco Strawberry/Raspberry Newtons Class Action Lawsuit
By Mike Holter
A class action lawsuit filed in California federal court claims that Nabisco’s marketing of Strawberry Newtons and Raspberry Newtons as “wholesome cookies” that are “made with real fruit” is false and misleading.
The truth, according to plaintiff Monique Manchouck, is that the products contain a minimum amount of real fruit, if any at all, coupled with “many unhealthy ingredients, chemicals and preservative additives.”
To top it off, the products are “just as unhealthy and full of sugar and chemicals as its competitors that do not claim to be ‘made with real fruit,’” the class action lawsuit says.
The Nabisco class action lawsuit lists all of the ingredients found in Strawberry Newtons and Raspberry Newtons, which show the products do not contain any dried or real fruit, but rather, “strawberry puree” and “raspberry puree.” Even then, these ingredients are “only a very insignificant portion in comparison to the amount of unhealthy ingredients, chemicals and preservative additives that are in the product,” the class action lawsuit says.
Manchouck says she and other consumers would not have purchased the Strawberry Newtons and Raspberry Newtons if they did not contain the “made with real fruit” distinction on the product label.
The class action lawsuit is brought on behalf of all California residents who have purchased, for personal use, Nabisco’s Strawberry Newtons or Raspberry Newtons that claimed to be “made with real fruit” since May 2009.
It is seeking full restitution, damages, injunctive relief and more for claims of unfair, fraudulent and unlawful business practices; false and misleading advertising; and violations of California business law.
The Nabisco Strawberry/Raspberry Newton False Advertising Class Action Lawsuit case is Monique Manchouck v. Mondelez International Inc. d/b/a Nabisco, Case No. 13-cv-2148, U.S. District Court, Northern District of California.
Manchouck is represented by Benjamin M. Lopatin of The Law Offices of Howard W. Rubinstein, P.A.

Raspberry Newtons were the best of all of the Newton products, whatever the ingredients. If you don’t like them, DON’T BUY THEM. Stop playing Food Police for everyone else. Don’t need ya, don’t WANT ya.
I love the Raspberry Newton’s! Can’t find them in Indiana. If you want real fruit, make your own cookies and don’t buy the Newton’s.
