A new class action lawsuit alleges Sled Distribution LLC, doing business as My Medic, violated Washington state law by sending deceptive marketing emails to consumers. 

Plaintiff Deborah Cerkezoglu claims My Medic used subject lines and email content designed to create a false sense of urgency, encouraging recipients to act immediately out of fear of missing out. 

“SLED spams Washington consumers, including Plaintiff, with commercial emails whose subject lines employ various tactics to create a fake sense of urgency in consumers’ minds,” the My Medic class action lawsuit says.

Cerkezoglu alleges this false urgency wastes consumers’ time by enticing them to engage with My Medic’s marketing emails and repeatedly directing them to act quickly before supposed deadlines expire. 

According to the class action lawsuit, the emails flood consumers’ inboxes with repeated notifications falsely suggesting the time to act, meaning to purchase, is short.

“And through this deceptive time-sensitivity, Sled falsely narrows the field—steering consumers away from shopping for better deals—to its own products and services which must be purchased now,” the complaint says.

Cerkezoglu wants to represent a class of Washington consumers who received My Medic’s allegedly deceptive commercial emails.

Cerkezoglu claims My Medic violated Washington’s Commercial Electronic Mail Act (CEMA) and Washington’s Consumer Protection Act by engaging in deceptive and unlawful email marketing practices.

My Medic class action: lawsuit challenges alleged false urgency tactics

The class action lawsuit claims My Medic’s alleged conduct is precisely the type of behavior Washington’s Commercial Electronic Mail Act was designed to prevent. 

Cerkezoglu alleges the company’s use of misleading urgency tactics amounts to harassment of Washington consumers through deceptive commercial email practices.

The plaintiff further claims these marketing practices distort consumer decision-making by interfering with consumers’ ability to comparison shop and make informed purchasing choices. 

According to the complaint, the alleged conduct benefits My Medic by directing consumers toward immediate purchases rather than allowing them time to consider alternatives.

Cerkezoglu seeks injunctive relief to stop My Medic from continuing the alleged email marketing practices. The class action lawsuit also requests all relief available under Washington law, including remedies for consumers injured by the alleged violations.

In other recent CEMA violations, Cotton On is also accused of sending spam emails to Washington consumers with misleading subject lines.
