Mirena IUD lawsuitA Mirena lawsuit has been filed against Bayer Healthcare Pharmaceuticals Inc. by a Georgia woman who alleges she suffered physical injuries from using Bayer’s Mirena IUD birth control product.

Plaintiff Shermekia J. is a 28-year-old woman who in September 2007 was implanted with the Mirena IUD, a long-term contraceptive designed, manufactured, and distributed by Bayer.

During the initial insertion procedure, Shermekia did not experience complication and the IUD was allegedly properly placed, according to the Mirena lawsuit. The plaintiff returned 10 months after the Mirena insertion for a follow-up examination, at which point in time Shermekia was again informed of the Mirena’s proper placement.

However, about a year after Shermekia started using Mirena for her birth control needs, she was diagnosed with ovarian cysts. The plaintiff has filed this Mirena personal injuries lawsuit under the belief that Bayer’s birth control product is the cause of her ovarian cyst condition.

Shermekia J. brings several allegations against Bayer in this Mirena lawsuit, including claims of defective manufacturing, design defect, negligence, failure to warn, strict liability, breach of implied warranty, breach of express warranty, fraudulent misrepresentation, and fraud by concealment.

The plaintiff is also seeking punitive damages, alleging Bayer knew of risks associated with their Mirena IUD contraceptive product and knowingly concealed the dangers and health risks from Shermekia, doctors, medical providers, the FDA, and other female consumers.

The Mirena Lawsuit is Case No. 3:14-cv-00628-JPG-PMF, in the U.S. District Court for the Southern District of Illinois.

Mirena IUD Complications and Side Effects

The Mirena IUD is a t-shaped plastic birth control device designed to be implanted in a woman’s uterus to release progestin and leveonorgestrel (synthetic hormones) into a woman’s bloodstream . Once these hormones are in the bloodstream, the Mirena IUD will “thicken cervical mucus, thin the uterine lining, inhibit sperm movement and reduce sperm survival to prevent pregnancy,” according to Bayer’s product packaging.

According to news reports and Mirena lawsuits, there are hundreds, if not thousands, of documented cases of the Mirena IUD migrating from the original implantation site, embedding itself, and even perforating the uterine lining.

Despite these reports and additional FDA’s warnings, Bayer has continued to manufacture, and sell Mirena IUD with no design alterations, and did not immediately change the product packaging to alert consumers and medical professionals of the migration and perforation dangers.

There are about 1,042 Mirena IUD lawsuits awaiting trial in federal court. The number of Mirena IUD lawsuits is expected to grow as more women file Mirena IUD lawsuits or join Mirena IUD class action lawsuits through 2015.
