- The fast-food giant argues the claims are โbaseless,โ saying the class action lawsuit does not claim that anyone was injured by its products or their packaging.ย

McDonaldโs fails to disclose to its customers that its food products, including its popular Big Mac burger, contain unsafe per- and polyfluoroalkyl substances (PFAS), a new class action lawsuit alleges.
Plaintiff Larry Clark claims McDonaldโs misleads consumers into believing its food is safe to eat by not disclosing that it contains PFAS, which he says are harmful to both humans and the environment.ย
โThe use of PFAS in its Products stands in stark contrast to McDonaldโs brand identity which espouses food safety,โ the class action lawsuit states. โIn almost every medium, McDonaldโs Corporation tells consumers, investors, and the general public that the Products are safe.โ
Clark wants to represent a nationwide class of consumers who have purchased McDonaldโs food products containing PFAS.ย
Clark claims McDonaldโs has โrepeatedly deniedโ that its food products contain PFAS, only finally admitting the truth last year.ย
Despite its alleged admission, Clark argues McDonaldโs still falsely represents that its food is โsafe, high quality and appropriate for consumption.โ
โDefendant fails to tell consumers that PFAS, which can have adverse effects on humans and can bioaccumulate in humanโs bodies, are present in high levels in its Products,โ the class action lawsuit states.ย
Exposure to PFAS can cause a number of adverse health effects, including liver damage, cancer and increased risk of asthma, among other things, according to the class action lawsuit.ย
โBecause PFAS persist and accumulate over time, they are harmful even at very low levels,โ the class action lawsuit states.ย
McDonaldโs chooses to included PFAS in food to cut costs
Clark claims McDonaldโs has the resources to ensure PFAS are not in its food products; however, he argues the company instead chooses to intentionally include them as a way to cut costs.ย
โThis โprofits over peopleโ approach allows McDonaldโs Corporation to save pennies per unit sold and instead pass these โcostsโ at a far greater rate onto generations of consumers that must live with the consequences of McDonaldโs willful inclusion and concealment of dangerous PFAS in McDonaldโs Products,โ the class action lawsuit states.ย
Clark claims McDonaldโs is guilty of unjust enrichment, among other things, and in violation of the Magnuson-Moss Warranty Act, the Illinois Consumer Fraud and Deceptive Business Practices Act and multiple state consumer protection statutes.ย
Plaintiff is demanding a jury trial and requesting injunctive and declaratory relief along with appropriate, monetary and compensatory damages for himself and all class members.
A separate class action lawsuit was filed against McDonaldโs earlier this month over claims the company spread lies about a company which fixes McFlurry machines to perpetuate a โservice and repair racketโ with the machines manufacturer, Taylor.ย

I have ate at McDonaldโs my whole life my children and grandchildren have eaten there throughout their lives also. I always wondered why it would hurt my stomach and I guess now I know. Please add me!!
Itโs been 2 maybe 3 years since I ate there. All the thing I been hearing. I may never eat fast food again. But yes I got my children McDonaldโs every day after school like most momโs. Now we have to live with ourselves knowing we put that mess into our babies. Only because we trusted McDonaldโs and money ainโt going to make us forget what we gave our kids.
