Puffy class action lawsuit overview:

A new class action lawsuit alleges mattress company Puffy uses fake sales and discounts to mislead consumers into purchasing its products.

Plaintiff Cassandra Webb claims that Puffy advertises fake discounts and regular prices on its mattresses and bedding products, creating a false sense of urgency for consumers to buy.

Webb claims she purchased a product from Puffy’s website that was advertised as being offered at a steep discount from its regular price. She says she believed she was getting a good deal and that the sale was time-limited.

However, Webb says she later discovered that the sale was not actually limited in time and that the product was always available at a discounted price. She alleges that Puffy’s regular prices are inflated and do not reflect the true market value of the products.

Class action: Puffy violates state consumer law

The Puffy class action lawsuit alleges that the company’s advertisements are unfair, deceptive and unlawful, violating California’s False Advertising Law, Consumers Legal Remedies Act and Unfair Competition Law.

Webb seeks to represent a nationwide class and a California subclass of consumers who purchased one or more Puffy products advertised at a discount on the company’s website.

The plaintiff is demanding a jury trial and requesting an order certifying the class action lawsuit and an award of damages, treble damages, punitive damages, restitution, disgorgement, pre- and post-judgment interest, injunctive relief and attorneys’ fees and costs.

Earlier, JCPenney faced a class action lawsuit accusing the retailer of running a widespread false discount scheme that misled customers into believing they were saving money when they were not. If you purchased a product from JCPenney advertised with a discount, you may have a legal claim.
