Buyers of luxury cars believe that they are getting a premium product but one California man claims in a class action lawsuit filed Tuesday that this is not the case with the 2014 Maserati he purchased, which he claims contains an antenna defect that prevents him and other owners/lessees from using the car’s satellite radio feature.
Plaintiff Earl Woody alleges in the Maserati class action lawsuit that Maserati North America Inc. is not only advertising and selling high-priced vehicles with defective components, but also embarking on a campaign to conceal the Maserati antenna defect by refusing to fix the problem.
The company has reportedly sold more than 1,000 of the 2014 Maserati vehicles, which are priced at $77,000 to $144,000 or more. Some of the features that might appeal to buyers, according to the Maserati class action lawsuit, include GPS, real-time traffic alerts as well as music, news and sports coverage. However, the satellite radio antenna reportedly does not have enough coverage for this.
As a result, the company has been in breach of contract when it sold these vehicles because they would not have paid the same price for a lack of GPS, satellite radio and other features, according to the Maserati class action lawsuit. In spite of allegedly knowing, or having the technical capability to ascertain the problem, Maserati reportedly has failed to fix the problem.
Instead, the plaintiff alleges that the company “attempted to buy off … potential plaintiffs by offering individual owners who have registered complaints regarding their antenna with individual settlements in exchange for a a release of all future claims against defendant and signing a confidentiality agreement forbidding them from disclosing information about their defective [products] to the general public.”
Woody is seeking to represent all similar 2014 Maserati owners and lessees who experienced antenna problems that made them unable to operate or enjoy the satellite radio feature advertised for their vehicle.
The Maserati antenna class action lawsuit comes at a time when a number of manufacturers and tens of millions of cars are under scrutiny via government investigation, litigation, as well as numerous recalls.
