A hernia repair patient has filed a Marlex mesh hernia lawsuitagainst Bard and Davol, alleging that her hernia mesh product caused severe side effects.
Plaintiff Betty W. recently filed a Marlex mesh hernia lawsuit against C.R. Bard Inc. and Davol Inc., alleging that the mesh used in her hernia repair surgery was defective and caused adverse health effects.
In August 2010, Betty says she underwent hernia repair surgery and was implanted with the Marlex hernia mesh, a Bard and Davol product. After her surgery, Betty alleges she experienced abdominal pain and other complications which caused her to be hospitalized multiple times.
Less than a month after her hernia repair surgery, Betty says she once again needed surgery to have the mesh removed. She was hospitalized multiple times after the removal due to continuing complications. In her Marlex mesh hernia lawsuit, Betty alleges that the mesh she was implanted with was defective and was the cause of her health problems.
There are a wide variety of mesh products available for use in hernia repair surgery, and some have been the subject of several defective product claims.
Numerous lawsuits have been filed against many different manufacturers after their mesh products caused bodily injury. In some cases, the lining and materials used in the mesh can cause a foreign body response. Other lawsuits report that the mesh adheres to the internal organs. Both of these reported responses, and others, can cause serious pain and other health problems which require the mesh to be removed.
In her lawsuit, Betty argues that the Marlex hernia mesh is one of these defective products. The Marlex hernia mesh has reportedly caused adverse complications in numerous patients. In 2005 and 2006, mesh products similar to the Marlex hernia mesh were recalled by the U.S. Food and Drug Administration (FDA). Betty says she was unaware that comparable products had been recalled and that the mesh used in her surgery may cause complications.
Betty allegedly sustained numerous damages from her implantation with the Marlex hernia mesh. In her Marlex mesh hernia lawsuit, Betty claims that she suffered from severe bodily injury, medical costs, additional surgery, additional hospitalization, additional physical therapy, mental anguish, loss of wages and loss of her former well being.
In her Marlex mesh hernia lawsuit, Betty argues that Bard and Davol should be held accountable for releasing an allegedly defective product that caused injury in her and others. She also claims that releasing a defective product is due to the manufacturers’ negligence and seeks to hold them accountable.
“Defendants are strictly liable to Plaintiff by reason of having designed, manufactured, tested, marketed, sold and placed into the stream of commerce and [sic] unreasonably dangerous product which was the direct and proximate cause of Plaintiff’s injuries and damages,” Betty argues in her Marlex mesh hernia mesh lawsuit.
Betty accused Bard and Davol of negligence, strict liability, and breach of warranties. The Marlex mesh hernia mesh lawsuit seeks compensatory and punitive damages in excess of $75,000, court costs, and attorneys’ fees.
The Marlex Mesh Hernia Lawsuit is Case No. 1:18-cv-02414-RDB in the Circuit Court for Baltimore County.
