A new class action lawsuit accuses Mario Badescu Skin Care of falsely advertising its facial spray as containing rosewater.

Plaintiff Mary Baker claims the company’s Skincare Facial Spray with Aloe, Herbs and Rosewater actually contains rosehip extract, not rosewater, despite being advertised as containing the latter.

Baker wants to represent a nationwide class and New York subclass of consumers who purchased at least one of the facial sprays in the United States within the applicable statute of limitations period.

“Defendant intentionally misleads consumers into believing that the product is made with rosewater,” the Mario Badescu class action lawsuit says.

Class action: Mario Badescu facial spray contains rosehip extract, not rosewater

Baker argues Mario Badescu misleads consumers into believing its facial spray contains rosewater because it is beneficial for the skin due to its anti-inflammatory properties, which can soothe skin irritation and reduce discoloration.

“However, unbeknownst to consumers, the product does not contain rosewater,” the Mario Badescu class action lawsuit says. “Rather, it contains Rosa canina bud extract (also known as rosehip extract).”

Baker says she and other consumers would not have purchased the facial spray, or would have paid less for it, had they known it did not contain rosewater.

Baker alleges Mario Badescu is guilty of fraud, breach of express warranty and violations of New York General Business Law. She demands a jury trial and requests declaratory relief and an award of actual, compensatory, statutory, nominal and/or punitive damages for herself and all class members.

Meanwhile, Kenvue Brands, doing business as Johnson & Johnson, recently faced a class action lawsuit alleging it falsely advertised Johnson’s Shea & Cocoa Butter Oil as being made from shea and cocoa butter, even though the product allegedly contains less than 1% of those ingredients.
