A new class action lawsuit filed against Margaritaville at Sea claims the cruise line is responsible for a data breach that compromised the personally identifiable information and protected health information of its customers.

Plaintiff Danielle Seaberg claims the Margaritaville at Sea data breach occurred after the cruise line failed to properly secure and safeguard the private information of its customers.

Seaberg wants to represent a nationwide class of individuals who had their private information compromised as a result of the Margaritaville at Sea data breach.

Seaberg argues Margaritaville at Sea failed to implement adequate and reasonable cybersecurity procedures and protocols necessary to protect the private information of its customers.

“Despite having the financial wherewithal and personnel necessary to prevent the data breach, [Margaritaville at Sea] nevertheless failed to use reasonable security procedures and practice appropriate to the nature of the sensitive, unencrypted information it maintained for the plaintiff and class members,” the Margaritaville at Sea class action lawsuit alleges.

Margaritaville at Sea allegedly failed to notify customers in timely manner

Seaberg argues Margaritaville at Sea failed to adequately protect the private information of its customers, warn them of its allegedly inadequate information security practices, effectively secure hardware containing protected private information and timely notify them of the data breach.

Seaberg claims Margaritaville at Sea is guilty of negligence and negligence per se, breach of implied contract and unjust enrichment. She demands a jury trial and requests declaratory and injunctive relief and an award of actual, compensatory, statutory and nominal damages for herself and all class members.

Meanwhile, WestJet Airlines Ltd. also faced a class action lawsuit after a data breach that exposed the personal information of more than 1.2 million customers.
