Manly Bands class action lawsuit overview:

A new nationwide class action lawsuit alleges Manly Bands misled customers by advertising false discounts and sales.

Plaintiffs Janine Nadal and Emalie Favela filed the class action complaint against Manly Bands on Nov. 13 in California federal court, alleging violations of state and federal consumer laws.

Manly Bands is a wedding band company that sells rings and jewelry on its website, manlybands.com. According to the lawsuit, the company advertises massive discounts for its products, even though the products are always on sale and never sold at the original reference prices.

The plaintiffs allege Manly Bands pretends to have seasonal or limited-time sales like a “Black Friday Sale,” “Labor Day Sale,” “Customer Appreciation,” “Prime Day Sale” or “Spring Sale.” However, the products are always on sale, and the so-called “deal” never ends, the plaintiffs say.

The company often uses fake countdown timers on its website to further create the illusion that any sales or deals are about to end, the class action lawsuit states.

Manly Bands customers paid more due to false discounts, plaintiffs claim

The plaintiffs argue that through this deceptive marketing, advertising and pricing scheme, Manly Bands violated Utah consumer protection laws. They also accuse the company of violating California law, which expressly prohibits falsely advertising goods on “sale” from fictitious former prices.

Nadal and Favela say they both purchased wedding bands from Manly Bands’ website that were falsely advertised as being offered at a discount during a limited-time sale. 

The plaintiffs claim they reasonably relied on Manly Bands false advertisements and would not have purchased the items or would have paid less for the items had they known about the deceptive advertising.

They are looking to represent anyone in the United States who purchased products from Manly Bands that were advertised with a discount and suing for violations of California and Utah consumer laws. They also seek certification of the class action lawsuit, damages, fees, costs and a jury trial.

In other alleged fake discounts, Jewelry maker Kendra Scott LLC is accused of advertising fictitious regular prices on its website.
