A Kentucky man alleges in a new lawsuit that he suffered from DePuy hip implant failure caused by metallosis side effects.
The plaintiff, Barry G., was implanted with a DePuy Pinnacle metal-on-metal hip device in his right hip on April 19, 2008. Unfortunately, in the following years, Barry alleges he began suffering from pain, discomfort, and even inflammation in his right hip. Eventually, he claims, he began to feel a dislocation or slipping feeling in the hip joint, and believed that the implant would no longer be able to support his weight.
In 2013, Barry says he was found to have excessively elevated levels of the metals cobalt and chromium in his bloodstream, allegedly due to the hip components rubbing together. As a result of this apparent DePuy hip implant failure, Barry underwent removal surgery on January 31, 2018.
Even now that the device has been removed, the DePuy hip implant failure has caused chronic pain and discomfort, Barry’s lawsuit claims. According to the lawsuit, Barry was not adequately warned about the risks of DePuy hip implant failure, including pain, difficulty standing or walking, fatigue, inflammation, infection, and metallosis, among other side effects.
Barry filed his DePuy hip implant failure lawsuit on May 3, 2018, in the U.S. District Court for the Northern District of Texas. The lawsuit was filed on multiple counts, including failure to warn, design defect, manufacturing defect, negligence, and several others.
Filing a DePuy Hip Implant Failure Lawsuit
Barry is far from the first to file a lawsuit over DePuy hip implant failure and related side effects. Indeed, more and more patients who have undergone revision surgery due to DePuy hip implant failure are filing lawsuits, alleging that the manufacturer failed to adequately warn about the risk.
The U.S. Food and Drug Administration (FDA) announced a DePuy voluntary recall of their ASR hip implant device back in August 2010. The manufacturing company’s recall affected around 93,000 total hip implant devices across the world. Around a third of these recalled devices were implanted in American patients.
Lawsuits claim that DePuy failed to adequately warn both the public and the medical community about the risks associated with their device, including DePuy hip implant failure. Had plaintiffs known about the risks linked with the DePuy hip implant, lawsuits claim, they would have chosen a safer alternative and avoided these complications altogether.
If you or someone you love has suffered from side effects after implantation with a DePuy ASR hip implant device, you may be able to file a DePuy hip implant failure lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by a defective hip implant, or reverse the damage done by side effects, it can help to alleviate the financial burden caused by medical expenses and lost wages.
